The applicant was available to address questions; however no public testimony was <br /> given. The Commission voted unanimously to approve the request as submitted. <br /> Financial Impact: None <br /> Explanation: The applicant requests a Special Use Permit to permit construction of a 4.5' x 7.5' front <br /> entry addition to the home at 1672 Canyon Lane. The proposed front entry addition would encroach <br /> approximately 4.5' into the required 30' front yard setback, for a total front yard setback of 25.5'. <br /> Zoning Code Section 4-040 (3) (B)provides for a maximum 6' encroachment of 35% of the width or the <br /> home or 12', whichever is less, when specified conditions are met. Staff has worked with the applicant <br /> to confirm that the submitted plans are in accordance with those conditions. <br /> The applicant currently is in possession of a building permit for other improvements at this property. It <br /> was at the time of building permit that the applicant was notified of the special use permit requirement <br /> for the covered front entry encroachment. The other improvements being done to the home include re- <br /> siding the home, construction of a new stoop, steps, railing and necessary retaining walls providing <br /> access to the front door. <br /> Staff reviewed the Special Use Permit criteria of Zoning Code Section 4-040(3)(B) and 8-130 and found <br /> all criteria are met.
