<br />t <br /> <br />~.. <br /> <br /># I <br /> <br />:. i <br /> <br />RESOLUTION No. 00-108 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF SPOO.16. <br /> <br />WHEREAS, an application for a special use permit has been made by Mark Beisswenger to <br />reconfigure the existing parking lot within the required setback in the MX Zoning District; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />I. An application for a special use penn it was filed with the City of New Brighton on <br />November 3,2000. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on November 21, 2000, and all persons present at the hearing were given an opportunity to <br />be heard. <br />3. The City Council considered the proposal at its November 28, 2000 meeting; and <br /> <br />Now THEREFORE BE IT REsOLVED, the Planning Commission makes the following Findings of <br />Fact in respect to SPOO-16: <br />1. The subject site is zoned MX, Mixed Use. <br />2. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use shall <br />be recommended by the Planning Commission unless such shall find: <br />1. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of general public. <br />2. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish <br />and impair property values within the neighborhood. <br />3. That the establishment ofthe special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />4. That adequate utilities, access roads, drainage and/or necessary facilities have been or <br />are being provided. <br />5. That the special use shall, in all other respects, confonn to the applicable regulations <br />of the district in which it located. <br />3. The proposed uses have been found to meet the above criteria. <br />4. Subject to approval of a landscape/streetscape plan, the required setbacks within the MX <br />Zoning District may be reduced; and <br /> <br />BE IT FURTHER RESOLVED, that based upon the above findings of fact the application SPOO-16 is <br />hereby recommended for approval subject to the following conditions: <br /> <br />1. Perimeter curbing must be installed around the off-street parking area. <br />2. All off-street parking and drive areas be paved with bituminous surface (with the <br />exception of the shared access area with the business to the south). <br />3. All off Street parking stalls shall be marked with white or yellow painted lines not less <br />than four (4) inches wide. <br />4. In order to reduce the front yard setback from 30 feet to 25 feet, the applicant shall be <br />responsible for installation of all required landscaping along Old Highway 8 to be <br />consistent with an approved landscape/streetscape plan to be completed by a landscape ; <br /> <br />C:\TEMPlSPOO.16A.wp<I <br />
