RESOLUTION NO. <br />11-107 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT <br />:WHEREAS, an application for a special use permit has been made by Tomco Company on <br />behalf of Gary & Kristen Johnson to permit construction of a front entry roof addition <br />at a setback of 25.5' when 30' is normally required and 24' is permitted by Special <br />Use Permit, and <br />REAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was filed with the City of New <br />Brighton on October 28, 2011, and <br />2. The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on November 15, 2011 and all present were given a chance to <br />freely speak at the hearing. <br />3. The Planning Commission recommended the City Council approve the Special <br />Use Permit on November 15, 2011. <br />4. The City Council considered the request on November 22, 2011. <br />WHEREAS, the Planning Commission and City Council make the following Findings of <br />Fact in respect to SP2011-014: <br />1. The subject site is zoned R-1, Single Family Residential District. <br />2. The applicant has submitted plans proposing a 4.5' x 7.5' covered front entry <br />roof addition at 1672 Canyon Lane, which consists of a 4.5' encroachment of <br />the required 30' front yard setback. <br />3. The applicant is requesting a Special Use Permit to allow the front yard <br />setback to be reduced to 24' in accordance with the following conditions <br />noted within Section 4-040 (3) (B): <br />a. The proposed addition uses the same exterior structure materials <br />and colors as the principal structure and accessories. <br />b. The roof is properly proportioned to and integrated with the roof of <br />the principal structure (dwelling) on the property. <br />C. The base of the addition is not open and its appearance is <br />consistent with the base of the building. <br />d. The structure shall not exceed 35% of the width of the front of the <br />dwelling, excluding the garage, or shall not exceed twelve feet in <br />width, whichever is less. <br />
