RESOLUTION NO. <br />11-104 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN, VARIANCE, AND <br />vIING USE PERMIT. <br />VHEOAS, an application has been made by Brandon Sigrist on behalf of Barley John's Brewpub <br />to p4mit construction of a 520 square foot solar electric array at 781 Old Highway 8 SW. <br />✓HEOAS, the procedural history of the application is as follows: <br />1.pplications for a Site Plan, Variance, and Nonconforming Use Permit were received on <br />leptember 29, 2011. <br />2. a Planning Commission, pursuant to published and mailed notices, held a public hearing <br />i October 18, 2011 and all present were given a chance to freely speak at the hearing. <br />3. e Planning Commission recommended conditional approval of the Site Plan, Variance, <br />I Nonconforming Use Permit on October 18, 2011. <br />4. ,he City Council tabled the request on October 25, 2011. <br />5. *e City Council considered the request on November 9, 2011. <br />✓IIE AS, the Planning Commission and City Council make the following Findings of Fact with <br />res ct to the Site Plan (LP2011-007), Variance (VN201 1 -001), and Nonconforming Use Permit <br />(N 011-003): <br />1. I he property is zoned B — 3, General Business. <br />2. e property is guided in the Comprehensive Plan for Community Business. <br />3. lhe applicant is proposing to construct a 520 SF solar electric array at the north end of the <br />,iroperty, which will be mounted on a concrete slap measuring approximately 45' x 15'. <br />4. lhe Planning Commission and City Council considered the Site Plan in accordance with the <br />— 3 district standards of Section 5-250 and the parking standards of Chapter 11 of the <br />ring Code. <br />5. 1 be Planning Commission and City Council found all applicable Site Plan standards to be <br />et with regard to setbacks, floor are ratio, building height, fence height/location, and <br />dscaping. The exception is the proposed array setbacks, where a variance was considered. <br />6. Variance was requested to allow the proposed solar electric array to be setback less than <br />e required 30' on all sides. Specifically, the proposal includes an 8' from the Long Lake <br />oad right-of-way line and a 4' setback from the Old Highway 8 SW right-of-way line. <br />7. be Planning Commission and City Council considered the proposed Variance in accordance <br />'th Zoning Code Section 8-210, which refers to Minnesota Statutes 462.357, subdivision 6. <br />8. he Planning Commission and City Council considered the proposed variance, specifically <br />garding the following crucial points of Minnesota Statues 462.357, subdivision 6: <br />Practical difficulties <br />Reasonable use <br />Applying to property <br />Developmen011-9-2011\LP2011-007, NC2011-003, VN2011-001 (Barley Johns) - <br />t <br />
