<br />! <br /> <br />; \ <br /> <br />. : <br /> <br />~ , <br /> <br />: ; <br /> <br />RESOLUTION NO. 00-106 <br /> <br />ST ATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION AUTHORIZING THE CITY TO ENTER PURCHASE <br />PROPERTY OWNED BY THE CANADIAN PACIFIC RAIL WAY AND TO <br />LEASE A PORTION OF SAME TO BELL LUMBER & POLE CO. <br /> <br />THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON makes the <br />following Findings of Fact: <br /> <br />1. The City wishes to purchase two parcels of land from the Soo Line <br />Railroad dba the Canadian Pacific Railway that are 40-feet wide and extend from <br />First Street NW on the south to the County Road E-2 extension to the north (the <br />"Soo Line Strip"); <br /> <br />2. The Williams Pipeline is situated within the Soo Line Strip and the City <br />finds that it is in the best interests of the health, safety and welfare of City <br />residents if the pipeline were relocated to facilitate the environmental cleanup of <br />the MacGillis & Gibbs Superfund Site; <br /> <br />3. The Canadian Pacific Railway is unwilling to permit Williams Pipeline to <br />relocate its pipeline on railroad property~ <br /> <br />4. The Canadian Pacific Railway is willing to sell the Soo Line Strip to the <br />City and has proposed a purchase agreement setting forth the terms of the sale and <br />the City's purchase; <br /> <br />5. A portion of the Soo Line Strip is currently leased by Bell Lumber & Pole <br />Co. and is used for storage purposes and as access between Bell Lumber's east <br />and west yards and Bell Lumber & Pole wishes to continue leasing a portion of <br />the Soo Line Strip for such pwposes; and <br /> <br />6. The Soo Line Strip may also be used for redevelopment purposes and as <br />additional road right-of-way. <br /> <br />NOW THEREFORE, the City Council hereby resolves: <br /> <br />1. To enter into the Purchase Agreement with Canadian Pacific Railway in <br />the form attached hereto as Exhibit A and authorizes the Mayor and City Manager <br />to execute the agreement accordingly; and <br /> <br />I:\S~\COUNCIL\Resolutions\2000\cd\Canadian Pacific Railway.wpd <br />
