(3)Animals and Pets. <br /> The terms of this Section shall apply to animals,pets, and reptiles whether wild or domesticated. <br /> A. No person owning, being in custody, or having control of an animal,pet, or reptile <br /> shall cause or allow it to roam or be at large in any open space site. <br /> B. No person being in custody of an animal,pet, or reptile shall permit it to enter any <br /> beach area, nature interpretive area, wildlife refuge, golf course or park building, whether <br /> leashed or otherwise, except a service animal <br /> trained to provide assistance to an individual with a disability, unless the person has <br /> received permission from the City Manager or designee prior to entering a public area or <br /> building. A person who is granted permission by the City Manager or designee must, <br /> prior to the animal,pet, or reptile entering a public area or building, agree to provide <br /> insurance in an amount required by the City and to defend and indemnify the City for any <br /> claims arising out of an accident or incident involving the animal, pet, or reptile. The <br /> City will provide the necessary form for this agreement. <br /> C. No person in custody of any animal, pet, or reptile shall allow it to disturb, harass, or <br /> interfere with other open space users or their property. <br /> D. Any unattended animal,pet, or reptile found roaming or at large within any open <br /> space site shall be impounded. <br /> E. All State and local ordinances relating to the licensing and muzzling of animals,pets, <br /> and reptiles shall apply when they are brought into any open space site. <br /> F. No person shall release or introduce an animal, pet, or reptile in any open space site <br /> without written permission of the Director. <br /> G. No person owning or in custody of an animal, pet, or reptile shall allow it to graze or <br /> browse in any open space site. <br /> The City Attorney has reviewed the proposed ordinance changes and recommended no additional <br /> changes to the proposed ordinance. <br /> Explanation: <br /> A group or organization wishing to bring an animal into a park facility would be required to fill <br /> out an Animal Displays—Insurance and Indemnification form. By signing this form the party <br /> would agree to supervise the animal, clean up after the animal, take safety precautions, provide a <br /> Certificate of Liability and comply with all other City of New Brighton ordinances.
