• <br /> RESOLUTION No. 98- <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF NC-109. <br /> WHEREAS, an application for a nonconforming use permit has been made by Richard Peterson. <br /> WHEREAS,the procedural history of the application for a nonconforming use permit is as follows: <br /> 1. An application for a nonconforming use permit was filed with the City of New Brighton <br /> on March 20, 1998. <br /> 2. The Planning Commission, pursuant to published and mailed notices,held a public <br /> hearing on April 21, 1998, and all persons present at the hearing were given an <br /> opportunity to be heard. <br /> 3. On April 28, 1998,the City Council considered NC-109. <br /> NOW,THEREFORE BE IT RESOLVED,the City Council makes the following Findings of Fact in respect <br /> to NC-109: <br /> 1. The subject site is zoned R-1, Single Family Residential. <br /> • 2. The following Type IV nonconformities exist on the subject site(2111 and 2203 Long <br /> Lake Road): <br /> a. The lot width of each lot is 30 feet. <br /> 3. The applicant has no possible way to reduce the nonconformity of either of these lots. <br /> 4. The applicant wishes to reconfigure the existing side lot line(without any effect on the <br /> nonconformity)to provide additional area to Parcel A for construction of a detached <br /> garage. <br /> BE IT FURTHER RESOLVED,the application NC-109 is hereby approved. <br /> Adopted this 28th day of April, 1998. <br /> Robert Benke,Mayor <br /> Margaret Egan, City Clerk <br /> Mathew Fulton,City Manager <br />
