HEAD'S APPROVAL: <br /> MANAGER'S REVIEW/RECOMMENDATION: <br /> No comments to supplement this report,/Pt- Comments attached <br /> The current City Code (Sec.4-72 and 4-108e)contain a prohibitions against brewers selling their product at <br /> retail with an on-sale license in the City. This portion of the City Code was based on state law at the time the <br /> ordinance was written (1973). <br /> The State changed the appropriate statute to permit this type of sale for"Brewpubs". <br /> The City Attorney has drafted a revision to the Code which conforms to statute and will permit"brewpubs"to <br /> operate in the City. <br /> II <br /> Recommendation: To hold and waive the first and second readings of an amendment to Chapter 4, Article IV, <br /> Division 2 , Section 4-72, and Chapter 4, Article V, Division 2, Section 4-108 (Persons Ineligible [to possess non- <br /> intoxicating malt liquor and on-sale intoxicating liquor licenses]). <br /> John C.
