Agenda Section:vI J I 7
CITY OF NEW BRIGHTON
Report Number: 99_050
REQUEST FOR COUNCIL CONSIDERATION
• Report Date: February 23, 1999
ITEM DESCRIPTION: Industrial Equities Group - Lakeview Business Center 6 (Site Plan Review)
LP-349
DEPT. HEAD'S APPROVAL: Kevin Locke,Director of Community Development
MANAGER'S REVIEW/RECOMMENDATION:
1/A No comments to supplement this report "Y1/ Comments attached
EXPLANATION/SUMMARY (attach supplemental sheets as necessary)
The City Council is asked to consider an application for a Site Plan review for Lakeview Business Center 6,which includes
the construction of a 48,000 square foot office/warehouse facility.
This item was continued from the January 26, 1999 City Council meeting in order for the applicant to respond to concerns
from the neighboring property to the north(Chenoweth's). Issues that have been raised by the Chenoweth's include:
Request for fencing along the lot line separating the two properties;Lighting potentially shining onto the Chenoweth
property; Trees on Old Highway 8 blocking view of the existing Chenoweth sign; The proposed building blocking out
sunlight into the green houses. Attached is a letter submitted by the Chenoweth's expressing their concerns.
In response to these concerns, John Allen of Industrial Equities, submitted a letter stating how the concerns would be
addressed(see attached letter).
he following highlights the issues:
Lighting: The proposed security lighting is located on the building. Per the lighting plan, at the Chenoweth property the
light is reduced to .17 foot candle. No direct light will be exposed at any lot line. The lighting plan meets the
City Code requirement.
Trees: Mr. Allen has agreed to locate trees so as not to effect the existing signage for Chenoweth's. The City Forester
reviewed the landscape plans, and recommended that the western most Pink Spire Crab and Colorado Spruce,
adjacent to the Chenoweth property,be eliminated from the plan to protect views of the Chenoweth sign(see
attached landscape plan.
Fencing: The City Code does not require fencing as part of a site plan review, therefore, it would be very difficult for the
City to require fencing in this instance, since the adjacent land is zoned for industrial uses. If the adjacent
property were zoned residential, then screening could be required. Mr. Allen has stated his reluctance to install
fencing.
Grading: The proposed grading plans are consistent with the overall grading plans approved for this area. Once the site
is final graded, the drainage problems should improve.
Sun Blockage: The New Brighton Zoning Ordinance does not regulate"sun rights". It simply regulates building setbacks
and height restrictions etc. In this instance, the proposal meets all City Code requirements including
setbacks and height restrictions. Therefore, it would be difficult for the City to deny a site plan based
upon blocking of the sun from the adjacent property.
•ttaehed for your reference is the Planning Report from January 26, 1999. Upon further review of the above issues, staff's
recommendation for approval remains,as all minimum City Code requirements have been satisfied.
I:ISHARED\000NCILIRE PO RTSN 999\IN DEQ D13.WPD
