13. The Planning Commission recommended Preliminary and Final Plat approval of the <br />amended request to the City Council on April 17, 2012. <br />114. The City Council considered the proposed plat on April 24, 2012. <br />WHMEAS, the Planning Commission and City ow <br />Council make the following Findings of Fact with <br />respect to the amended Preliminary and Final Plat of NEW BRIGHTON EXCHANGE IST <br />Apt)ITION (PL2011-001, FP2011-001): <br />1. The property is zoned NWQ, Northwest Quadrant. <br />2. The plat is to be known as NEW BRIGHTON EXCHANGE IT ADDITION. <br />13. The property is located within in the Northwest Quadrant redevelopment area, <br />generally north of I-694, east of Old Highway 8 NW, south of 14a' Street NW, and <br />west of I35W. <br />4. The preliminary and final plat was originally reviewed and approved in 2011 and <br />the amended plat does not entail any substantive changes, other than lot layout, <br />j which is why the preliminary and final plat review processes are running <br />simultaneously. <br />5. The lot layout was amended to address environmental concerns. <br />6. The preliminary and final plat includes creation of seven outlots, Outlots A — G, <br />NEW BRIGHTON EXCHANGE 11T ADDITION, and dedication of roadway to be <br />known as Northwest Parkway. <br />7. The Planning Commission held a public hearing on the amended preliminary and <br />final plat on April 17, 2012 and all persons were given the opportunity to be <br />heard. <br />8. Section 26-33 of the City Code provides the following qualifications governing <br />approval of a preliminary plat: <br />A. The Planning Commission may return a conditional recommendation. The <br />City Council may require revisions as it deems necessary for the health, <br />safety, general welfare, order and convenience of the City. <br />B. The approval of a preliminary plat indicates that the subdivider may proceed <br />toward fulfilling the necessary steps for approval of the final plat in <br />accordance with the terms of approval. <br />C. No plat will be approved for a subdivision which covers an area subject to <br />periodic flooding or which contains extremely poor drainage facilities and <br />which would make adequate drainage of the streets and lots impossible. <br />6. The Planning Commission and City Council reviewed the above qualifications with <br />regard to the original preliminary plat and finds the amended preliminary plat of <br />NEW BRIGHTON EXCHANGE 1sT ADDITION remains consistent with these <br />criteria. <br />7. Section 26-41 of the City Code establishes the data necessary for a final plat. <br />8.
