<br />i I <br />~' \ . <br /> <br />. <br /> <br />RESOLUTION No. 00-079 <br /> <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF A PRELIMINARY AND FINAL PLAT OF <br />CERTAIN PROPERTY WITHIN THE CITY OF NEW BRIGHTON (NORTHWEST CORNER OF COUNTY ROAD E2 <br />AND 5TH AVE. NW). <br /> <br />WHEREAS, an application for final plat has been made by Main Street Village, LLC.; and <br /> <br />WHEREAS, the procedural history of the application is as fol1ows: <br />; . I. An application for final plat was filed with the City of New Brighton on July 28, 2000. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on August 15,2000, and all persons present at the hearing were given an <br />opportunity to be heard. The Planning Commission unanimously recommended <br />approval of the request subject to conditions. <br />3. The City Council considered the proposed preliminary & final plat at its August 22, <br />2000 meeting; and <br /> <br />Now, THEREFORE BE IT RESOLVED, the City Council of the City of New Brighton now makes the <br />following Findings of Fact in respect to the Preliminary and Final Plat for PLOO-7: <br /> <br />1. The City's Comprehensive Plan designates the subject site for Neigbborhood Commercial <br />Uses. <br />2. The subject site is zoned 1-2, Heavy Industrial, however, is subject to a rezoning per the <br />Comprehensive Plan. <br />3. The proposed mixture of retail and office uses are allowed in the 1-2 Zoning District. <br />4. The property is currently under construction, and contains 7.3 acres. <br />5. The applicant is proposing to divide the property into four (4) commercial lots. <br />6. The proposed plan complies with the lot standards of the 1-2 district, and is consistent with <br />the City's Comprehensive Plan. <br />7. The Plat contains al1 required easements. <br />8. Grading and utility plans have been approved for the site per PUD-7. <br />9. The subject site would be adequately served by public streets and public utilities. <br /> <br />BE IT FURTHER RESOLVED, the application for Preliminary and Final Plat, PLOO-7 is hereby <br />approved subject to the following conditions: <br /> <br />I. Vacation of the 6th Street right-of-way. <br />2. The developer/landowner shall be responsible for the maintenance of Main Street. <br />3. All easements shall be subject to review and approval of the City Engineer. <br />
