OIl <br /> <br />I <br />I, <br /> <br />!- <br /> <br />" <br /> <br />l'~ <br /> <br />RESOLUTION No. 00-074 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING ApPROVAL OF VNOO-6. <br /> <br />WHEREAS, an application for a 12.25-foot side yard street setback variance has been made by <br />Mike Prebonich to construct a 14 x 30 foot addition to an existing attached garage located at 1706 18th <br />Avenue NW; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />I. An application for a variance was filed with the City of New Brighton on July 28, 2000. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on August 15,2000, and all persons present at the hearing were given an opportunity to be <br />heard. The Planning Commission unanimously recommended denial ofthe request. <br />3. The City Council considered the proposed variance at its August 22nd, 2000 meeting; and <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to VNOO~6; <br /> <br />1. The subject site is zoned R-l, Single Family Residential. <br />2. The applicant is requesting a 14 x 30 foot addition to an existing attached garage located at <br />1706 18th Avenue N W The required side yard street setback for structures constructed prior <br />to 1981 within the R.l district is IS-feet. <br />3. The existing home contains a two stall garage, however, the applicant needs additional room <br />for boat and car storage, in addition to providing room for some of his tools. <br />4. The applicant does not wish to construct a detached garage, as there are few in any detached <br />garages within this neighborhood. <br />5. The proposed setback of2.75 feet would slightly "stick out" when compared to other homes <br />and garages along 17th Street NW, however, would generally be in character with the <br />neighborhood, and does not effect the existing tree line within the boulevard of 17th Street. <br />6. Where there are practical difficulties or unusual hardships in the way of carrying out the strict <br />letter ofthe provisions ofthe City of New Brighton Zoning Ordinance, the Council shall have <br />the power, in a specific case, to permit a variance from the provisions of this ordinance. The <br />crucial points ofthe variance are: <br />a. Undue hardship <br />b. Unique circumstances <br />c. Confonnance with the Comprehensive Plan <br />d. Variance shall not be detrimental to adjacent property or to the public as a whole. <br />6. The hardship is caused by the need to store additional boats, cars and tools inside of the <br />attached garage rather than outside to "clean up" the site. There are no detached garages <br />within this neighborhood, therefore, the applicant desires to construct an attached garage, <br />however, there in not adequate area on the site to construct a traditional three stall garage <br />without the need for a variance. <br />7.
