RESOLUTION NO. <br />12-056 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />V MAKING FINDINGS OF FACT AND APPROVING AN AMENDMENT TO A PREVIOUSLY <br />SPECIAL USE PERMIT. <br />✓HEF*As, an application has been made by Tom Van Pelt on behalf of Citizens State Bank out of <br />Hud$on, WI to be considered for an amendment to a previously approved Special Use Permit, <br />revigipg the allowed use of the fourth floor of the building at 1820 Old Highway 8 NW, known <br />as the Rush Lake Office Building. <br />✓HEI*AS, the procedural history of the application is as follows: <br />1. 'the City Council approved Resolution 05-039 on April 26, 2005. <br />2. the City Council approved Resolution 06-029 on March 28, 2006. <br />3. he City Council approved Resolution 07-119 on November 27, 2007. <br />4. 4 application for a Special Use Permit Amendment was received on June 15, 2012 and was <br />5. J�emed complete on July 2, 2012. <br />he Planning Commission, pursuant to published and mailed notice, considered the request <br />d held a public hearing on July 17, 2012. <br />6. a Planning Commission recommended approval on July 17, 2012. <br />7. e City Council considered the request on July 24, 2012. <br />✓HE AS, the Planning Commission and City Council make the following Findings of Fact with <br />respeut to the Special Use Permit Amendment (SP2012-003): <br />1. A Site Plan and Special Use Permit were previously approved for 1820 Old Highway 8 NW <br />by Resolutions 05-039 and 06-029, the respective Planning Reports outlining development of <br />t.ie site in compliance with the MX, Mixed Use zoning district standards. <br />2. A Site Plan Amendment was previously approved by Resolution 07-119, revising the <br />stribution of exterior materials on the building. <br />3. a proposed Special Use Permit Amendment to eliminate the mixed use component of the <br />ilding, by revising the land use of the fourth floor from residential to office is being <br />uested to provide for better marketing to a potential end user. <br />4. a Planning Commission and City Council reviewed the amendment request as it relates to <br />ailable off-street parking and the special use permit criteria of Zoning Code Section 6-550 <br />Id 8-130. <br />5. 'e Planning Commission and City Council determined conformance with off-street <br />rking standards and the special use permit criteria of Zoning Code Sections 6-550 and 8- <br />0 based on the following points: <br />A total usable building square footage (floors 1-4) of 15,378 SF demands 77 parking <br />stalls based on a 1 stall / 200 SF parking ratio. <br />The developed site plan provides for 77 off-street parking stalls <br />q. The change of use on the fourth floor does not alter the building placement on the lot <br />or the intent to take advantages of views of Long Lake Regional Park and Rush Lake. <br />All pedestrian linkages north, south, and east will not be altered. <br />A solely office use is permitted in the MX, Mixed Use Zoning District. <br />C\CO CIL\REPORTS\2012\Community Development\7-24-20121SP2012-003 (Citizens State Bank) - RESOLUTIONAm 1 <br />
