'! <br /> <br />!. <br /> <br />,_ i <br /> <br />"I <br /> <br />RESOLUTION No. 00-061 <br /> <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT APPROVAL OF PRELIMINARY PLAT OF CERTAIN PROPERTY <br />WITHIN THE CITY OF NEW BRIGHTON (SOUTH END OF 10TH A VB. NW, NORTH OF COUNTY ROAD E). <br /> <br />WHEREAS, an application for preliminary plat has been made by Nedegaard Homes; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />j \ <br /> <br />1. <br /> <br />An application for preliminary plat was filed with the City of New Brighton on <br />June 2, 2000. <br />The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on June 20, 2000, and all persons present at the hearing were given <br />an opportunity to be heard. The Planning Commission unanimously <br />recommended approval of the request subject to conditions. <br />The City Council considered the proposed preliminary plat at its June 27'h, 2000 <br />meeting; and <br /> <br />2. <br /> <br />: / <br /> <br />3. <br /> <br />Now, THEREFORE BE IT RESOLVED, the New Brighton City Council now makes the following <br />Findings of Fact in respect to PLOO-4: <br /> <br />2. The City's Comprehensive Plan designates the subject site for Single Family <br />Residential. <br />3. The subject site is zoned R-2, Two Family Residential. <br />4. Single family homes are allowed in the R-2 Zoning District. <br />S. The property is presently vacant, and contains 1.16 acres. <br />6. The applicant is proposing to divide the property into four (4) single family residential <br />lots. <br />7. The proposed plan complies with the lot standards of the R-I district, and is consistent <br />with the City's Comprehensive Plan. <br />8. The subject site would be adequately served by public streets and public utilities. <br /> <br />BE IT FURTHER RESOLVED, the application for Preliminary Plat, PLOO-4 is hereby approved <br />subject to the following conditions: <br /> <br />1. Submittal of a Grading and Drainage Plan subject to review and approval of the City <br />Engineer. <br />2. Submittal of a Utility Plan subject to review and approval of the City Engineer. <br />3. The Final Plat shall contain legal descriptions (Lot & Block) for each proposed new <br />lot, all required easements and the name of the subdivision. <br />4. All homes within the proposed subdivision meet the City's minimum setback <br />requirements for the R-l, Single Family Residential zoning district. <br />S. Each new home proposed for constructed within the subdivision must submit a <br />grading plan with their application for a building penn it. Said grading plans must be <br />consistent with the overall grading plan approved as part of the Final Plat. <br />6. Approval of a pennit by the Rice Creek Watershed District (RCWD). <br />
