<br />" <br /> <br />.~ <br /> <br />~ <br /> <br />.' <br /> <br />RESOLUTION No. 00-059 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL FOR PUDOO-l AND LPOO-7 (PHASE 2). <br /> <br />WHEREAS, an application for an amended Planned Unit Development has been made by Pratt <br />Ordway Properties and the City of New Brighton; and <br /> <br />WHEREAS, the procedural history of the application for a nonconforming use permit is as <br />follows: <br />1. <br /> <br />2. <br /> <br />An application for Phase 2 of a PUD was filed with the City of New Brighton on June <br />2, 2000. <br />The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on June 20, 2000, and all persons present at the hearing were given an <br />opportunity to be heard. The Planning Commission unanimously recommended <br />approval subject to conditions (Vote: 6-0). <br />The City Council at its regularly scheduled Council meeting on June 27th, 2000 <br />considered the proposal; and <br /> <br />3. <br /> <br />Now, THEREFORE BE IT RESOLVED, the New Brighton City Council makes the following <br />Findings of Fact in respect to PUDOO-l, Phase 2: <br /> <br />1. The subject site is zoned I~ 1, Light Industrial and 1-2, Heavy Industrial. <br />2. Phase 2 of the PUDOO-l site is roughly 1.2 acres in size, and will consist of a 12,000 <br />square foot office building. The entire development area is roughly 10 acres in size. <br />3. The subject site is also identified as the Brighton Corporate Park III site, part of a large <br />industrial park which the City began redeveloping in 1988. <br />4. The existing surrounding land uses from Phase 2 vacant land to the north, residential <br />to the east and industrial to the west and south. <br />S. The proposed PUD is consistent with the City's Comprehensive Plan which states the <br />subject site should be developed with limited industrial or neighborhood business <br />uses. <br />6. The building and site design for proposed PUDOO-l, Phase 2 would be compatible <br />with and compliment surrounding land uses. <br />7. A traffic study has been completed by SEH to determine the impacts on adjacent <br />roadways. <br />8. The findings ofthe SEH study determined that the existing traffic level at the <br />intersection of Old Highway 8 NW and Sib Avenue meet certain warrants for a stop <br />light. <br />9. Future traffic levels at the intersection of Sib Avenue and County Road E2, based on <br />future development in the area including Main Street Village, meet certain warrants <br />for a stop light. <br /> <br />BE IT FURTHER RESOLVED, the City Council hereby approves PUDOO-l, Phase 2, subject to the <br />following conditions: <br /> <br />; " <br /> <br />I. Allowance for flexibility in the perimeter setback requirement for PUD's, the building <br />setbacks may be decreased to 8 feet as proposed, subject to the construction of the <br />proposed streetscape plan dated 4-14-00. <br />
