Ms. <br /> Gundlach confirmed that the applicant is required to submit both a dust mitigation plan as well as an odor <br /> mitigation plan prior to the end of January or February 2012. <br /> Chairperson Howard opened the Public Hearing at 7:41pm. Norm Wells, the applicant explained that <br /> this revision came as a result of the impact of the east side parking; noting this is a much better solution. <br /> Commissioner Danger asked what the current space is used for. Mr. Wells stated currently that area is <br /> used for testing; noting that function will move to another building. <br /> Motion by Commissioner McPherson, seconded by Commissioner Alvey to close the Public <br /> Hearing. <br /> Approved 7-0 <br /> Motion by Commissioner Danger, seconded by Commissioner McPherson to approve staff <br /> recommendation with two conditions as stated in the resolution. <br /> Approved 7-0 <br /> (B) City of New Brighton requests a Zoning Code Amendment to Chapter 9 of the Zoning <br /> Code, specifically Section 9-046, regarding use and display temporary signs. <br /> City Planner Gundlach reported that this is a Zoning Code Amendment directed by the City Council. <br /> This amendment specifically and only impacts temporary signs as regulated in Zoning Code Section 9- <br /> 046. This amendment does not impact use of all types of temporary signs (example: garage sale signs, <br /> real estate signs, etc.). It was noted that section 9-046 of the Zoning Code is frequently violated by <br /> businesses throughout the City. The current code allows each business and/or lot to display two <br /> temporary signs per calendar year, not to exceed 32 square feet in size. A temporary sign permit is <br /> required to track compliance with these rules. <br /> The Planning Commission held several work sessions and examined the use of temporary signs and how <br /> other communities handle these types of signs. The Planning Commission also offered the Economic <br /> Development Commission the chance to review the issues and provide comment. <br /> The Commission is recommending numerous changes in an effort to balance use of temporary signs by <br /> businesses with maintaining a nice aesthetic environment residents demand. <br /> The changes include: <br /> • Allow 4 permits per year rather than 2 <br /> • Alter the display time from 30 days to 14 days <br /> • Cut the permit fee in half <br /> • Allow one sandwich board sign to be used and displayed by every business all day every day <br /> • Provide a definition of sandwich board sign(36"x 24") <br /> • Exempt grand openings and going out of business sales from the temporary sign permit process <br /> • Allow permits to be issued back to back if desired by the business <br /> 2 <br />
