General Overview <br /> 1) Clearwire presented plans to the City for construction of a 100' <br /> monopole tower. Plans showed a tower with a 20.5" base plate on a <br /> 36" round foundation. <br /> 2) City approved special use permit with conditions: <br /> a. Must handle existing ball field lights. <br /> b. Extendable to 115' and co-locatable for up to 3 or 4 carriers. <br /> 3) City also approved lease as a separate action. <br /> 4) Clearwire presented same plan set as #1, with modifications to meet <br /> City conditions. Plan set was used for both building permit and lease. <br /> 5) City subsequently discovered that actual tower was much larger (46"- <br /> 48" in diameter with 84" round foundation). <br /> City's Position <br /> • Clearwire built tower that was not in compliance with special use <br /> permit and lease; much larger than drawings previously shown. <br /> Clearwire's Position <br /> • Clearwire built tower that met City's conditions. Engineered design <br /> was approved by City building official. <br />
