Minneapolis, MN • Extensive experience as a civil litigator in the areas of appellate litigation, insurance-coverage litigation,and commercial litigation. • Litigated more than 86 appeals and 77 dispositive motions since 1995. • Handled more than 237 depositions or contested oral arguments since 1995. • Conducted more than 62 mediations as a qualified neutral mediator since 1995. • Conducted appellate oral argument before the Supreme Court of the United States, Eighth Circuit Court of Appeals,Ninth Circuit Court of Appeals, Minnesota Supreme Court,and Minnesota Court of Appeals. • Petitioned the United States Supreme Court for certiorari in Plains Commerce Bank v. Long Family Land& Cattle Co., and handled briefing and oral argument on the merits as lead counsel of record in 2008, which resulted in a 5-4 opinion reversing the decision of four lower courts and holding that a tribal court lacked adjudicatory jurisdiction over a discrimination claim against a nonmember defendant. • Successfully litigated a substantive consolidation involving$700 million in false Ponzi scheme profits tc make those funds available to creditors of the bankruptcy estate in one of the largest frauds in Minnesota history. • Brought two procedural motions in the Minnesota Court of Appeals(Harvey v. Dots, Inc.; Clifford v. Bundy)that resulted in the issuance of special term opinions for the benefit of the Minnesota Bar. • Obtained a reversal from the 91h Circuit Court of Appeals six days after oral argument(Sunrich. Food Group. Inc. v. Pacific Foods of Oregon). • Served as lead counsel heading up a team of 9 members in a two-week jury trial in federal court seeking insurance coverage for a Superfund cleanup,and obtained over$7.2 million in defense costs. • Reconstructed$22 million in historical insurance and established duty to defend for Superfund cleanup on behalf of policyholder. • Served as lead counsel in a one-week jury trial seeking insurance coverage for asbestos liabilities. • Obtained nearly$3.5 million in D&O defense-expense reimbursement for a receivership in one of the largest financial fraud schemes ever to be litigated. • Developed reconstruction of 40 years of historical insurance coverage,obtained defense and indemnity participation from historical primary carriers in hundreds of underlying actions, negotiated multi-million dollar policy buyback from historical London Market Insurers, and coordinated corporate strategy in large-scale asbestos litigation Doc#2360007\2
