Tobacco Regulation Memo Page 2 <br /> The League of Minnesota Cities and the Public Health Law Center, an anti-smoking advocacy <br /> group, have created a"model ordinance"for the regulation of smoking, a copy of which is attached. <br /> This ordinance was presented to the New Brighton Public Safety Commission and the Commission <br /> was urged by a representative of the Ramsey Tobacco Coalition to adopt it. I believe the Public <br /> Safety Commission decided to pass the model ordinance along to the City Council without any <br /> specific recommendations. <br /> The model ordinance has a number of features that are not currently included in the New Brighton <br /> Code. Among these are limitations that: regulate the sale of"tobacco related devices" (including <br /> ashtrays); limit the locations where tobacco stores can be located (not within 1,000 feet of a school, <br /> playground, church or youth oriented facility and not within 2,000 feet of another licensed tobacco <br /> retailer); and prohibit the sale of single cigarettes. <br /> If the Council wishes to extend the protection of the Clean Indoor Air Act to smoking shops, which <br /> would have the effect of prohibiting hookah lounges, it could do so by adopting the attached <br /> ordinance that prohibits all smoking in a licensed tobacco shop. If the Council is interested in <br /> extending the regulation of tobacco further, such as regulating the sale of tobacco related products <br /> or the locations where tobacco shops can be licensed, staff could prepare an ordinance adopting the <br /> model ordinance or any elements of that ordinance that the Council feels should be considered. <br /> CLL:peb <br /> Enclosure <br />
