<br />~ <br /> <br />(" <br /> <br />RESOLUTION No. 00-034 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND DENIAL OF VNOO-l. <br /> <br />WHEREAS, an application for a 16.82 foot lot width variance has been made by Eric & Kelly Love <br />for the purpose of subdividing a new lot located at 2924 16th Street NW; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance was filed with the City of New Brighton on March 29,2000. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on April 18th, 2000, and all persons present at the hearing were given an opportunity to be <br />heard. The Planning Commission recommended denial (V ote: 5~ I); and <br /> <br />NoW THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to VNOO-l: <br /> <br />1. The subject site is zoned R-l, Single Family Residential. <br />2. The required lot width in an R-l, Single Family Residential zoning district is 75 feet. <br />3. The applicant is requesting a 16.82 foot lot width variance to create a 58.18 foot wide lot. <br />4. Valerie Lane was originally going to connect with 16th Terrace. Access to the north half of <br />the subject property was to be provided off of that street connection. <br />5. A sewer and water stub was extended off of Roxanna Lane, however, the subject landowner <br />was never assessed for those improvements. <br />6. The City has granted lot width variances in the past, however, in each instance the proposed <br />lot width, which did not meet the City Code requirement, was similar to existing lots in that <br />particular neighborhood. In this instance, there are no lots located on Valerie Lane or <br />Roxanna Lane that do not meet the minimum required 75 foot lot width. <br />7. Had Valerie Lane been extended to 16th Terrace, the subject lot would have lost 30-feet off <br />the north end for road right-of-way purposes, therefore, the subject lot would be less than <br />the required 10,000 square feet in lot area. <br />8. Where there are practical difficulties or unusual hardships in the way of carrying out the strict <br />letter of the provisions of the City of New Brighton Zoning Ordinance, the Council shall have <br />the power, in a specific case, to penn it a variance from the provisions of this ordinance. The <br />crucial points of the variance are: <br />a. Undue hardship <br />b. Unique circumstances <br />c. Conformance with the Comprehensive Plan <br />d. Variance shall not be detrimental to adjacent property or to the public as a whole. <br />9.
