Report Number 13-018 <br /> iirj�PPON Agenda Section VI-3 <br /> the city that works for you Council Meeting Date January 22, 2013 <br /> REQUEST FOR COUNCIL CONSIDERATION <br /> ITEM DESCRIPTION: Consideration of an amendment to a previously approved Minor Subdivision, <br /> per Resolution 12-079, for 106 Cleveland AVE SW. <br /> DEPARTMENT HEAD'S APPROVAL: Grant Fernelius, Community Development Director <br /> CITY MANAGER'S APPROVAL: <br /> No comments to supplement this report Comments attached <br /> 15.99 Deadline: N/A <br /> Recommendation: Adopt the resolution provided, approving revised legal descriptions for the <br /> previously approved Minor Subdivision of 106 Cleveland AVE SW per originally approved Resolution <br /> 12-079. <br /> Legislative History: October 9, 2012: The City Council considered this request and held a public <br /> hearing. The City Council adopted Resolution 12-079, approving the requested subdivision creating one <br /> additional lot for development of a single family home, subject to two conditions. <br /> Financial Impact: Not applicable <br /> Explanation: Following the October 9, 2012 minor subdivision approval, the applicant started the <br /> process to purchase the newly subdivided lot. At that time it was discovered the original legal <br /> descriptions depicted on the subdivision Certificate of Survey were in error and needed to be corrected. <br /> The error is very minor and does not impact the subdivision layout or any of the original conditions of <br /> approval. The error relates to the description of the second "NE 'A" of the first line of the existing and <br /> proposed legal descriptions. The original survey left out the second "NE 1/4" reference. In order to <br /> correct this error, a new resolution must be adopted reflecting the correct legal descriptions.
