RESOLUTION No. 13- STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON RESOLUTION AMENDING RESOLUTION 12-079, APPROVED BY THE CITY COUNCIL ON OCTOBER 9,2012 WHEREAS, on October 9, 2012 the City Council of the City of New Brighton adopted Resolution 12-079, approving the Minor Subdivision of 106 Cleveland AVE SW, creating one additional lot for development of a single family home, and WHEREAS, it has since been determined that the proposed legal descriptions of the subdivided parcels were in error and corrections were needed to ensure saleable, marketable property. Now, THEREFORE BE IT RESOLVED, that Findings of Fact paragraphs 9 and 10 of Resolution 12-079 are hereby amended to read as follows: "9. The existing property is legally described as follows: That part of the N '/2 of the S '/2 of the NE 'A of the NE 1/4 of Section 32, T.30, R.23, Ramsey County, MN lying southerly of the north 105.0 feet and easterly the east line of the T.H. 394-35W. Subject to roads. 10. The proposed legal descriptions of the subdivided parcels are as follows: Proposed Description—Proposed Tract A That part of the south 110.0 feet of the N '/2 of the S 'A of the NE 1/4 of the NE '/4 of Section 32, T.30, R. 23, Ramsey County, MN, lying easterly of the east line of T.H. 394-35W. Subject to roads. Proposed Description—Proposed Tract B (homestead parcel) That part of the N '/2 of the S 'A of the NE 'A of the NE 1/4 of section 32, T.30, R. 23, Ramsey County, MN, lying southerly of the north 105.0 feet; northerly of the south 110.0 feet and easterly of the east line of T.H. 394-35W. Subject to roads." BE IT FURTHER RESOLVED,that the final paragraph of Resolution 12-079 is amended to read as follows: "NOW THEREFORE BE IT RESOLVED, that based upon the above findings of fact the application for a Minor Subdivision(MS2012-002) is hereby approved as depicted on attached Exhibit A, and subject to the following conditions: 417544v2 CLL NE136-8
