16.14 Intermittent Leave <br /> Employees may be required to use FMLA leave when the employee misses work <br /> due to an injury obtained while on duty. If this is required, the City will provide <br /> the employee written notification specifying that any absence will be counted <br /> against the employee's remaining FMLA time. The FMLA leave and workers <br /> compensation leave run concurrently. <br /> 16.15 Return to Work <br /> An employee returning from leave should notify their supervisor as soon as <br /> possible of there anticipated return to work date. The employee will be required <br /> to submit a fitness for duty or return-to-work report, signed by the treating doctor, <br /> prior to returning to work if FMLA leave was for the employee's own serious <br /> health condition. <br /> The employee will be reinstated to the same or equivalent position with <br /> equivalent benefits, pay and other terms and conditions of employment upon <br /> returning to work. However, an employee has no guaranteed right to <br /> reinstatement or other benefits if the employee would not have been continuously <br /> employed during the FMLA leave. For example, the employee will not be <br /> reinstated: 1) if the employee is laid off during the course of the FMLA leave, 2) if <br /> a shift is eliminated, or 3) if the employee was hired for a specific term to work on <br /> a discrete project and the term or project is over. <br /> 16.16 Minnesota Parental Leave Act <br /> As indentified in Minnesota Statutes sections 181.940 — 181.941, certain <br /> employees are entitled up to six (6) weeks of unpaid parenting leave upon the <br /> birth or adoption of a child. Eligible employees are those who have: <br /> • Been employed by the City for at least 12 consecutive months <br /> preceding the request for leave; and <br /> • Worked an average of 20 hours or more per week. <br /> The leave must begin within six weeks of the birth or adoption of a child. A <br /> request for parental leave must be made ninety (90) days in advance of the first <br /> day of the parental leave. The leave must begin not more than six weeks after <br /> the birth or adoption of the child, unless the child remains in the hospital longer <br /> than the mother, then the leave must not begin more than six weeks after the <br /> child leaves the hospital. No vacation or sick leave, or other benefits shall accrue <br /> during a parental leave period. The employee shall be eligible for group health <br /> insurance benefits during the parental leave, but will be responsible for any costs <br /> of insurance premiums during the parental leave. <br /> 16.17 School Conference and Activities Leave <br /> As noted in Minnesota Statutes section 181.9412, an employee will be granted <br /> up to a total of 16 hours during any 12-month period to attend school <br />
