Rear yard building setback less than 20' at 18'. <br />Side yard parking setback (east side) less than 5' at 3.5'. <br />Required number of off-street parking stalls is less than required at 64 when 174 are <br />required for the existing building and an additional 14 stalls are required for the <br />proposed addition. <br />10. he Planning Commission and City Council considered the Nonconforming Use Permit in <br />cordance with Section 8-460 (2) and the following criteria: <br />The total number of nonconformities is reduced. <br />The impact of any nonconformity upon adjacent premises is reduced to the greatest <br />practical extent. <br />The extent of any nonconformity is reduced where practical. <br />11. a Planning Commission and City Council found the nonconforming use permit standards <br />be met based on the following findings: <br />It is not practical to eliminate or reduce the building or parking setback <br />nonconformity. <br />The building and parking setback nonconformities have little impact on adjacent <br />properties as the nonconformity amounts to less than 2' in both cases. <br />The applicant has provided proof of parking plans illustrating the property can <br />accommodate enough parking to meet minimum off-street parking requirements under <br />Chapter 11 of the Zoning Code. <br />The nature of the applicant's business is such that the typical manufacturing off-street <br />parking ratio would produce extreme excesses of off-street parking based on the <br />applicant's floor plan to employee ratio. <br />Now HEREFORE BE IT RESOLVED, that based upon the above Findings of Fact the application <br />for i Site Plan (LP2013-003) and Nonconforming Use Permit (NC2013-002) are hereby <br />app ved, subject to the following conditions: <br />1. a proposed improvements are built in accordance with the plans submitted and attached to <br />e Planning Report dated 4/10/2013. <br />2. 1 mplementation of the recommendations contained in the interoffice Engineering/Public <br />orks memo dated 4/9/2013 and attached to the Planning Report. <br />3. 71e applicant enters into a Proof -of -Parking Declaration prior to issuance of a building <br />4. nstruction of any of the proposed proof of parking stalls shall require a separate Site Plan <br />d Rice Creek Watershed District approval. <br />5. a Landscape Pan is revised to ensure compliance with the 50% deciduous/50% coniferous <br />it uirement as outlined in the Planning Report. <br />6.
