Sec. 15-60. Restrictions. <br /> The conditions of this Section shall apply to the issuance of a license. <br /> (1)No license shall be issued except to a person of good moral character. <br /> (2)No license shall be issued for the sale of tobacco at any place other than the applicant's established <br /> place of business. <br /> (3)No license shall be issued for the sale of tobacco at more than one place of business. <br /> (4)No person shall sell or give away tobacco to any person under eighteen years of age. <br /> (5)No person shall keep for sale,sell, or dispose of any tobacco containing opium,morphine,jimson <br /> weed, bella donna, strychnia, cocaine,marijuana,or any other deleterious or poisonous drug except <br /> nicotine and other substances found naturally in tobacco or lawfully added as part of the manufacturing <br /> process. Age Restrictions. <br /> No person under eighteen years of age shall purchase,possess, or consume tobacco. (Ord. Expiration. <br /> The license shall be valid for a period of one year beginning April 1st and ending March 31st. Penalties. <br /> This Section prescribes administrative penalties for violation of this Article. The penalty amounts shall be <br /> as specified in Minnesota Statutes, Section 461.12. No penalty under this Section shall take effect until the <br /> licensee has received written notice of the alleged violation and has had an opportunity for a hearing <br /> before the City Council. The notice may be served personally or by mail. The decision of the City <br /> Council shall be provided in writing if a violation is determined to have occurred. Judicial appeal shall be <br /> as provided for by State law. <br /> 15-7 <br />
