RESOLUTION NO. <br />13 -062 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />JHE�AS, an application has been made by AT &T Mobility to allow construction of six <br />tele . nmunications antennas, but up to nine antennas, on top of the City's south water tower <br />located at 660 5`h Street SW, and <br />WHERI AS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on March 8, 2013. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />April 16, 2013 and all present were given a chance to freely speak at the hearing. <br />3. l e Planning Commission recommended the City Council approve the request on April 16, <br />20l 3.. <br />4. e 60 day review period was extended through a letter sent by City staff on April 17, 2013 <br />t July 7, 2013, then extended by the applicant to August 13, 2013 through an email sent on <br />J e 13, 2013, <br />5. Ae City Council considered the request on August 13, 2013. <br />IHER AS, the Planning Commission and City Council make the following Findings of Fact with <br />respe c t to the Special Use Permit (SP2013 -002): <br />1. e property is zoned I -1, Light Industrial. <br />2. e property is guided in the Comprehensive Plan for Business Park. <br />3. le applicant has proposed to construct six telecommunications antenna on top of the City <br />ter tower. <br />4. Tit proposal also includes installation of ground equipment within the water tower structure. <br />5. Section 4 -600 (2 & 4) provides for several performance related standards that all wireless <br />4ecommunication facilities must meet. <br />6. The Planning Commission and City Council determined those criteria of Section 4 -600 (2 & <br />4 ) are met. <br />7. T4e Planning Commission and City Council reviewed the proposal in accordance with the <br />following additional Special Use Permit standards of Zoning Code Section 8 -130: <br />4a. That the establishment, maintenance, or operations of the special use will not be <br />I detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />b, That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />c That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />
