PLANNING REPORT <br /> DATE: September 13, 2013 <br /> CASE: PL2013-001, FP2013-001, PD2013-001, PU2013-001, ZA2013-001 <br /> SUBJECT: Plat, Planned Unit Development, and Zoning Code Amendment to allow <br /> creation of 89 single family lots & 32 townhomes and dedication of public <br /> right-of-way <br /> APPLICANT: Ian Peterson on behalf of Pulte Homes of Minnesota <br /> REQUEST&BACKGROUND <br /> The applicant is requesting several land use approvals to allow development of 27 acres of land <br /> within New Brighton Exchange into 89 single family homes and 32 townhomes, including <br /> dedication of public roadways. The development, known as Enclave at New Brighton Exchange, <br /> will be phased over a period of 2-3 years, with Phase 1 beginning construction this fall. The <br /> requests include: <br /> • Zoning Code Amendment to allow for one-family detached dwellings within the NWQ, <br /> Northwest Quadrant Zoning District. <br /> • Preliminary Plat of approximately 37 acres of land. The City is the current property <br /> owner and would retain proposed Outlot A, comprising approximately 10 acres, for a <br /> future City park. <br /> • Final Plat of Phase 1. Phase 1 includes 61 single family lots to be platted into 5 blocks. <br /> The remaining 21 acres will be platted into Outlots A— G. The City will retain Outlot A <br /> and Pulte would acquire Outlots B — G. Outlots C, D, and G would be final platted by <br /> Pulte Homes at a later date for housing and Outlots B,E & F would be retained for open <br /> space. <br /> • Preliminary Planned Unit Development approval for 89 single family homes and 32 <br /> townhomes on 27 acres of land. <br /> • Final Planned Unit Development approval for Phase 1, consisting of 61 single family <br /> homes. Pulte would be required to undergo Final Planned Unit Development approval <br /> for the remaining Outlots that would be developed into an additional 28 single family <br /> homes and 32 townhomes. <br /> Community Development staff have been in contact with Pulte Homes since April 2012. Pulte <br /> Homes initially approached the City regarding the development of single family homes within <br /> New Brighton Exchange. Because lower density residential (specifically single family) was not <br /> originally envisioned for the area, Pulte met with the Planning Commission, Economic <br /> Development Commission, and the City Council at work sessions to determine if such a proposal <br /> could meet the overall development vision and financial goals. Ultimately, the City Council <br /> entered into a Private Contract for Redevelopment with Pulte on June 11, 2013. Under the terms <br /> of this agreement, Pulte will acquire approximately 27 acres of land on the west side of Old <br /> Highway 8 NW, within New Brighton Exchange, for construction of single-family homes and <br /> townhomes. Pulte is scheduled to close on the land around October 15th, but no later than the <br /> end of the year. Much of this will depend on Pulte obtaining approval from the MN Pollution <br /> Control Agency. While nearly all the land has been cleaned up, some pockets of contamination <br /> remain that Pulte will take responsibility for clean-up.
