which the applicant obtains a building permit and begins construction. The compliance date is <br /> the date by which the development is complete. For a staged development, commencement and <br /> compliance dates shall be specified for each phase. Because this request is for final PUD <br /> approval for Phase 1 only, staff would recommend the following commencement and <br /> compliance dates for Phase 1: <br /> Commencement Date: June 1, 2014 <br /> Compliance Date: December 31, 2018 <br /> At the time the applicant seeks final PUD approval for the remaining phases, commencement <br /> and compliance dates shall be established at that time. However, the compliance date will likely <br /> remain as December 31, 2018, as that is the completion date identified under the Contract for <br /> Private Redevelopment between the City and Pulte. Changes or extensions to the <br /> commencement or compliance dates require City Council approval. <br /> PRELIMINARY PLAT ANALYSIS <br /> Preliminary plat approval is being sought for the entire 37 acre development, which includes 89 <br /> single family lots, 32 townhomes, Outlots A — G, dedication of additional Old Highway 8 NW <br /> right-of-way, and dedication of public roads to be known as Northwest Parkway, Searles Street, <br /> 14th ST NW, Devine Drive, and Hipp Circle. The City will retain Outlot A for development of a <br /> future park. Future phases of Outlots G (single family), C (townhomes), and D (townhomes) <br /> will require final plat approval by the City Council prior to development. <br /> Section 26-32 establishes the data necessary for preliminary plat submittal and the procedures <br /> under which the City shall review the plat. All required submittals were received, reviewed by <br /> all departments, and found to be satisfactory. Also, all required legal notices were met. <br /> Additionally, Section 26-33 establishes the following qualifications governing the preliminary <br /> plat(staff responses in italics): <br /> (1) The Planning Commission may return a conditional recommendation. The City Council may <br /> require revisions as it deems necessary for the health, safety, general welfare, order and <br /> convenience of the City. <br /> Staff would recommend a condition of approval related to the County Surveyor's review. <br /> (2) The approval of a preliminary plat indicates that the subdivider may proceed toward fulfilling <br /> the necessary steps for approval of the final plat in accordance with the terms of approval. <br /> Final plat approval for Phase 1 will run simultaneously with the Preliminary Plat. Final plat <br /> approval for subsequent phases will be pursued by the applicant at later dates. <br /> (3) No plat will be approved for a subdivision which covers an area subject to periodic flooding <br /> or which contains extremely poor drainage facilities and which would make adequate drainage of <br /> the streets and lots impossible. <br /> There are not flood impacted areas within the preliminary plat. <br /> The preliminary plat will create 89 single family lots, seven outlots, and dedication of right-of- <br /> way for Old Highway 8 NW, Northwest Parkway, 14th ST NW, Searles Street, Devine Drive, <br /> and Hipp Circle.
