RESOLUTION <br /> PLANNING COMMISSION <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A ZONING <br /> CODE AMENDMENT, PRELIMINARY AND FINAL PLANNED UNIT DEVELOPMENT, AND <br /> PRELIMINARY AND FINAL PLAT TO BE KNOWN AS ENCLAVE AT NEW BRIGHTON <br /> EXCHANGE. <br /> WHEREAS, an application has been made by Pulte Homes of Minnesota to be considered <br /> for a Zoning Code Amendment, Preliminary Planned Unit Development, Final Planned <br /> Unit Development of Phase 1, and Preliminary and Final Plat for property on the west <br /> side of Old Highway 8 NW within the New Brighton Exchange Redevelopment Area <br /> located generally north of I-694, west of I-35W, and south and east of Long Lake <br /> Regional Park, and <br /> WHEREAS,the procedural history of the applications are as follows: <br /> 1. Applications for a Zoning Code Amendment, Preliminary and Final Planned Unit <br /> Development, and Preliminary and Final Planned Unit Development were received <br /> on August 29, 2013. <br /> 2. Public hearing notices for the requests were published in the New Brighton Bulletin <br /> on September 4, 2013. <br /> 3. Public hearing notifications were mailed to all property owners within 600' of the <br /> subject property on September 5, 2013. <br /> 4. The Planning Commission, pursuant to published and mailed notices, held a public <br /> hearing on September 17, 2013. <br /> 5. The Planning Commission recommended conditional approval of the requests on <br /> September 17, 2013. <br /> WHEREAS,the Planning Commission makes the following Findings of Fact with respect to <br /> the Zoning Code Amendment (ZA2013-001), Preliminary and Final Planned Unit <br /> Development (PD2013-001, PU2013-001), and Preliminary and Final Plat of Enclave at <br /> New Brighton Exchange (PL2013-001, FP2013-001): <br /> 1. The property is located on the west side of Old Highway 8 NW within in the New <br /> Brighton Exchange redevelopment area, also termed Northwest Quadrant, located <br /> generally north of I-694, west of I35W, and south and east of Long Lake Regional <br /> Park. <br /> 2. The property is zoned NWQ,Northwest Quadrant. <br /> 3. The property is guided in the New Brighton Comprehensive Plan for CC, City Center. <br /> 4. In order to allow single family residential uses within the NWQ zoning district, and <br /> ordinance amendment is required. <br /> 5. All residential uses are consistent with the CC, City Center land use designation in <br /> the Comprehensive Plan. <br /> 6. The proposed Zoning Code Amendment to the NWQ, Northwest Quadrant zoning <br /> district, allows one family detached dwelling units, but only in conjunction with an <br /> approved Planned Development. <br /> 7. The Planning Commission determines that requiring a Planned Development for one <br /> family detached residential uses within the NWQ zoning district provides a process to <br />
