Redeveloper acknowledges that the final plat for Long Lake Landing is <br /> being finalized for recording and that the Redevelopment Property is <br /> within a larger area that City is currently registering as Torrens property. <br /> Redeveloper and City agree that the Redeveloper's project will be <br /> processed as part of a Planned Unit Development(PUD)as defined <br /> under Chapter 7,Article 2 of the New Brighton Zoning Ordinance. The <br /> Redeveloper shall submit the appropriate application materials as <br /> required under such Chapter. <br /> Special Assessment for <br /> Intersection Improvement: Redeveloper will agree to an assessment of up to$25,000 for planned <br /> traffic signals at the first three intersections north of Interstate 694 along <br /> Old Highway 8. These signals are anticipated to be needed when the <br /> office and mixed uses located on the east and west sides of Old Highway <br /> 8 begin to generate substantial amounts of traffic. The signals will be <br /> installed sometime in the year 2009 or later depending on the volume of <br /> traffic. <br /> Association/Maintenance: Redeveloper will cooperate with City and with housing redevelopers to <br /> the north of the site as to the creation of an association or execution of <br /> maintenance agreements to address allocation of responsibility for and <br /> cost of maintenance of shared irrigation systems, landscaping,ponds and <br /> lighting and snow plowing and street sweeping of private roads. <br /> Site Improvements: All utilities are already available to the Redevelopment Property. <br /> Redeveloper shall construct all Site Improvements according to City- <br /> approved plans in accordance with the City's ordinary and customary <br /> requirements: <br /> • Sanitary sewer <br /> • Water mains and stubs <br /> • Storm sewers and storm water system elements <br /> • Landscaping <br /> • Pedestrian improvements <br /> • Grading and import/export of soil <br /> No utilities need to be relocated. <br /> Title: City to provide marketable title and a commitment for an Owners Policy <br /> of Title Insurance from Land Title Inc. ("Title"). Any title insurance <br /> and/or endorsements requested by the Redeveloper will be paid for by <br /> Redeveloper. <br /> Survey: City to provide a survey sufficient to convey marketable title. <br /> Minimum Improvements: Redeveloper shall construct the following Minimum Improvements on <br /> the site: <br /> 2 <br />
