CITY OF NEW BRIGHTON <br /> COUNTY OF RAMSEY <br /> STATE OF MINNESOTA <br /> RESOLUTION NO. <br /> A RESOLUTION AUTHORIZING EXECUTION AND DELIVERY OF AN <br /> EXTENSION TO THE LISTING AGREEMENT WITH WELSH <br /> COMPANIES, LLC D/B/A COLLIERS INTERNATIONAL/MINNEAPOLIS- <br /> ST.PAUL <br /> BE IT RESOLVED by the City Council (the "Council") of the City of New Brighton, <br /> Minnesota (the "City") as follows: <br /> Section 1. Recitals. <br /> 1.01 The Council previously authorized a Listing Agreement (the "Agreement") <br /> with Welsh Companies, LLC ("Welsh")on June 28, 2011 for marketing commercial lands in <br /> New Brighton Exchange. <br /> 1.02 Welsh subsequently changed its corporate affiliation to Welsh Companies, <br /> LLC d/b/a Colliers International / Minneapolis-St. Paul ("Welsh/Colliers"). <br /> 1.03 The Agreement with Welsh/Colliers expired on June 27, 2013. <br /> 1.04 The City and Welsh/Colliers desire to continue working together by extending <br /> the date of the Agreement to December 31, 2014 (the "Extension"). <br /> Section 2. Findings. <br /> 2.01 The Council hereby finds that the Extension to the Listing Agreement with <br /> Welsh/Colliers is consistent with the City's Modified Development Program established <br /> pursuant to Minnesota Statutes, Section 469.124 et seq. and the Tax Increment Financing <br /> Plan for Tax Increment Financing District No. 32 and 32A(NWQ Special Law), established <br /> pursuant to Minnesota Statutes, Section 469.174 et seq. and Laws of Minnesota 1998, <br /> Chapter 389, Article 11, Section 24. <br /> Section 3. Approval of Agreement and Authorization to Execute. <br /> 3.01 The City Council hereby approves the Extension to the Listing Agreement <br /> with Welsh/Colliers and authorizes the Mayor and City Manager(the"Officers")to execute <br /> and deliver the agreement when the following condition is met: <br />
