RESOLUTION No. <br />13 -075 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />LUTION APPROVING-T$E VACATION OF -A -10' DRAINAGE -AND—UTI .ITY -EASEMENT <br />.TED ALONG THE NORTHERN 10' OF LOT 1, BLOCK 4, LONG LAKE LANDING <br />IN THE NEW BRIGHTON EXCHANGE REDEVELOPMENT AREA. <br />WHEREAS, the City Council, pursuant to published notice, held a public hearing on <br />tember 24, 2013 to consider the vacation. All persons present at the hearing were <br />:n an opportunity to be heard; and <br />WHEREAS, the City of New Brighton, current owner of the property, acknowledges <br />vacation is necessary to allow the plat of Enclave at New Brighton Exchange, and <br />WHEREAS, Pulte Homes of Minnesota, future buyer of the property and preparer of <br />Enclave at New Brighton Exchange plat, has made application for the easement <br />it ion and prepared the necessary drawings in support of the vacation, and <br />WHEREAS, no utilities currently reside within the easement area, as Lot 1, Block 4, <br />NG LAKE LANDING was never developed and its existing use is vacant land. <br />Now, THEREFORE, BE IT RESOLVED, the City Council makes the following Findings <br />o F Fact in respect to the proposed vacation for EV2013 -001: <br />1 The subject area is zoned NWQ, Northwest Quadrant. <br />?. The City of New Brighton has determined the 10' drainage and utility easement is <br />not necessary as the lot is currently vacant and no utilities reside within the <br />easement area. <br />3. The City of New Brighton further acknowledges that new drainage and utility <br />easements will be dedicated in conjunction with the plat of Enclave at New <br />Brighton Exchange. <br />4. A public hearing was held on September 24, 2011, and all present were given a <br />opportunity to be heard. <br />5. The legal description of the 10' drainage and utility easement to be vacated is as <br />follows: <br />The north 10 feet of said Lot 1, Block 4, LONG LAKE LANDING <br />
