RESOLUTION NO. 13 -076 STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON ON MAKING FINDINGS OF FACT AND APPROVING A ZONING CODE AMENDMENT, gARY AND FINAL -P-LANNED -UNIT I)EvnLopmENT, AND - PRELIMINARY -AND -FINAL BE KNOWN AS ENCLAVE AT NEW BRIGHTON EXCHANGE. , an application has been made by Pulte Homes of Minnesota to be considered ring Code Amendment, Preliminary Planned Unit Development, Final Planned ✓elopment of Phase 1, and Preliminary and Final Plat for property on the west old Highway 8 NW within the New Brighton Exchange Redevelopment Area generally north of I -694, west of 1 -35W, and south and east of Long Lake Park, and , the procedural history of the applications are as follows: _ ications for a Zoning Code Amendment, Preliminary and Final Planned Unit Development, and Preliminary and Final Planned Unit Development were received on August 29, 2013. Public hearing notices for the requests were published in the New Brighton Bulletin on September 4, 2013. Public hearing notifications were mailed to all property owners within 600' of the subject property on September 5, 2013. The Planning Commission, pursuant to published and mailed notices, held a public hearing on September 17, 2013. The Planning Commission recommended conditional approval of the requests on September 17, 2013. 6. The City Council considered the request on September 24, 2013. W REAS, the Planning Commission and City Council make the following Findings of ct with respect to the Zoning Code Amendment (ZA2013 -001), Preliminary and Final tuned Unit Development (PD2013 -001, PU2013 -001), and Preliminary and Final Plat Enclave at New Brighton Exchange (PL2013 -001, FP2013 -001): 11. The property is located on the west side of Old Highway 8 NW within in the New Brighton Exchange redevelopment area, also termed Northwest Quadrant, located generally north of I -694, west of 135W, and south and east of Long Lake Regional Park. 2. The property is zoned NWQ, Northwest Quadrant. 3. The property is guided in the New Brighton Comprehensive Plan for CC, City Center. In order to allow single family residential uses within the NWQ zoning district, and ordinance amendment is required. 5. All residential uses are consistent with the CC, City Center land use designation in the Comprehensive Plan. 6. The proposed Zoning Code Amendment to the NWQ, Northwest Quadrant zoning district, allows one family detached dwelling units, but only in conjunction with an approved Planned Development.
