Hereby approved, subject to the following conditions prior to the release of the Final Plat <br />of Enclave at New Brighton Exchange unless otherwise expressly provided for otherwise: <br />1. The applicant enters into a PUD Agreement and Subdivision Agreement. <br />?. Final Plat and Final PUD approval is obtained for future development of Outlots C, <br />D, and G. <br />3. Accessory structures on the single family lots shall be regulated in accordance with <br />Zoning Code Section 4 -530, except as otherwise regulated through the established <br />- HOA-s-and -that-structural -- coverage- may -be -increased -to -48% of 4he -lot area -and <br />hardcover to 55% of the lot area. <br />4. At least 75% of the single family homes shall be constructed with a brick/stone <br />element on the street fagade of the home. The remaining 25% of homes shall be <br />excluded from this requirement, subject to the applicant incorporating a non- <br />monotony clause, as described at the Planning Commission meeting, within their <br />homeowner's association bylaws. All townhome units shall contain at least 30% <br />brick/stone on the street fagade. <br />Incorporation of the comments contained in the interoffice Engineering and Public <br />Safety memorandums, attached as exhibits to this report, to the satisfaction of City <br />staff. <br />The Commencement Date for Phase 1 shall be June 1, 2014. The Compliance Date <br />shall be December 31, 2018. Commencement and compliance dates for future phases <br />shall be established as part of the final PUD approval. <br />7. Submission of a copy of their Rice Creek Watershed District permit. <br />8. Review and acceptance of the plat by the Ramsey County Surveyor. <br />9. Payment of park dedication fees for Phase 1 in the amount of $99,430 ($1,630 x 61 <br />1 lots) at the time of City Council approval of the final plat. <br />LO. Provide a plan for a monument sign(s) and enter into an agreement regarding <br />construction and maintenance thereof, as required by City staff, all subject to the <br />review and approval of City staff. <br />1 I. Provide a street sign plan, subject to the review and approval of City staff. <br />11 Provide homeowners association documents subject to the review and approval of <br />City staff. <br />1 . Provide evidence of title as required by Minn Stat. §505.03 and the City Attorney. <br />The above - mentioned evidence of title shall be subject to the review and approval of <br />the City Attorney to determine what entities must execute the Final Plat and other <br />documents to be recorded against the property. Further, the City shall be provided <br />with evidence, which sufficiency shall be determined by the City, that all documents <br />required to be recorded pursuant to this Resolution, City Code and /or by the City <br />Attorney are recorded and all conditions for release of the Final Plat have been met <br />prior to the City processing or approving any building permits or other permits <br />applicable to the development of the Property. <br />14. Pulte Homes of Minnesota shall pay upon demand all expenses, determined by the <br />City, that the City incurs in relation to this development and Resolution, and shall <br />provide an escrow deposit in an amount to be determined by the City. Said expenses <br />shall include, but are not limited to, staff time, including, but not limited to, hourly <br />wage, overhead and benefits, engineering, legal and other consulting fees incurred in <br />relation to the development. <br />
