Report Number 13-234 <br /> BRICITIUN Agenda Section VI-4 <br /> the city that works for you Council Meeting Date October 8, 2013 <br /> REQUEST FOR COUNCIL CONSIDERATION <br /> ITEM DESCRIPTION: Consideration of an Ordinance Summary concerning publication <br /> requirements for Ordinance No. 818. <br /> DEPARTMENT HEAD'S APPROVAL: Grant Fernelius, Community Development Director <br /> CITY MANAGER'S APPROVAL: <br /> No comments to supplement this report Comments attached <br /> Recommendation: Adopt the Resolution r ided, accepting the ordinance summary for publication. <br /> Legislative History: September 24, 2013: The City Council approved Ordinance No. 818, regarding <br /> amendments to the NWQ, Northwest Quadrant Zoning District in support of the land use applications <br /> submitted by Pulte Homes of Minnesota, LLC. <br /> Financial Impact: Publication costs are calculated by column inch. Publishing a summary in place of <br /> the entire ordinance (13 pages)will save at least $600. <br /> Explanation: At the September 24, 2013 meeting Council adopted Ordinance 818, making <br /> amendments to the NWQ,Northwest Quadrant Zoning District permitting one family detached dwelling <br /> units. This action was necessary to facilitate the Pulte Homes project within the New Brighton <br /> Exchange redevelopment area. In accordance with Minnesota Statutes 412.191, ordinances only <br /> become effective upon the date of their publication in the official City newspaper. This same statute <br /> recognizes that publishing an entire ordinance can be burdensome and provides an allowance of a <br /> summary to be published in place of the entire ordinance if the Council determines that publication of <br /> the title and a summary of the ordinance would clearly inform the public of the intent and effect of the <br /> ordinance. However, summaries must be approved by a four-fifths vote of the City Council prior to <br /> their publication. Staff proposes the following title and summary for publication in lieu of the full, 13 <br /> page ordinance: <br /> "Ordinance No. 818: An Amendment Related to One Family Detached Dwellings in the NWQ, <br /> Northwest Quadrant Zoning District. Ordinance No. 818 was adopted by the City Council of the City <br /> of New Brighton on September 24, 2013, amending Chapter 6, Article 6 of the Zoning Code to permit <br /> one-family detached dwelling units within the NWQ, Northwest Quadrant Zoning District. Per <br /> Ordinance No. 818, one-family detached dwelling units are only permitted as part of a Planned <br /> Development, as regulated in Chapter 7 of the Zoning Code. Certain criteria for site standards, building <br /> type, parking requirements, and building materials have been specified for one-family detached dwelling <br /> units as part of Ordinance No. 818. Additionally, Section 9-730 regarding street types has been repealed <br /> and Figure 3 pertaining to Building Types has been amended.
