Consideration of a Resolution authorizing execution of a First Amendment to 1.Consideration of a <br /> the Contract for Private Redevelopment by and between the City of New Resolution authorizing <br /> execution of a First <br /> Brighton and Pulte Homes of Minnesota, LLC for the sale and redevelopment of Amendment to the <br /> land in New Brighton Exchange. Report No. 13 250. Resolution No. 13-085. Contract for Private <br /> Redevelopment by and <br /> CityManager Lotter explained CommunityDevelopment Director Femelius would be presentingthis item to between the city of <br /> g p p New Brighton and <br /> the Council. Pulte Homes of <br /> Community Development Director Femelius explained Pulte Homes of Minnesota has been working with Minnesota,LLC for <br /> the sale and <br /> the City since April2012 on a proposal to build single-family homes on a 27 acre tract of land in New redevelopment of land <br /> Brighton Exchange. The Council authorized a Contract for Private Redevelopment with Pulte on June 11, in New Brighton <br /> 2013. Among the provisions in the Agreement is an inspection period of 120 days for Pulte to conduct due Exchange.RepoitNo. <br /> 13-250. <br /> diligence on the site,including any environmental approvals from the Minnesota Pollution Control Agency Resolution No. 13-085 <br /> (MPCA). Pulte has indicated that the MPCA still has not approved their submittals and the company wants <br /> an additional 60 days to complete that work Staff recommended the Council adopt a Resolution authorizing <br /> execution of a First Amendment to the Contract for Private Redevelopment by and between the City of New <br /> Brighton and Pulte Homes for the sale and redevelopment of land in New Brighton Exchange. <br /> Mayor Jacobsen questioned if there was an issue with the MPCA or the developer. Ian Peterson,Pulte <br /> Homes,sincerely apologized for the entire situation. He explained there was an error with the amount <br /> escrowed for the environmental cleanup and the amount that would be paid for the property. In addition,the <br /> MPCA has required additional testing and cleanup on the site. He anticipated that Phase I would still be <br /> completed by next spring. <br /> Mayor Jacobsen asked if the additional cleanup would delay closing on the property. Mr.Peterson stated the <br /> closing would not be delayed as the cleanup would occur after the property was purchased. <br /> Motion by Councihnember Bauman,seconded by Councilmember Jacobsen to adopt a Resolution <br /> authorizing the execution of a First Amendment to the Contract for Private Redevelopment by and <br /> between the City of New Brighton and Pulte Homes,of Minnesota,LLC for the sale and <br /> redevelopment of land in New Brighton Exchange. <br /> 5 Ayes,0 Nays-Motion Carried <br /> Commission Liaison Reports,Announcements and Updates <br /> Commission Liaison <br /> Dean Lotter Reports. <br /> City Manager Lotter reported the Council would be conducting a utility rate analysis at the Announcements and <br /> Updates <br /> November 26th worksession meeting. The Council would be discussing the 2014 budget on <br /> December 3rd and the budget would be adopted on December 10th. He noted the National <br /> League Conference would be held in Seattle, Washington on November 13th through the 16th. <br />
