<br />which is acceptable under rules and regulations adopted by the Department <br />of the Treasury. Benefit election changes are consistent with status changes <br />for accident or health coverage only if (1) the change in status results in the <br />Participant, Participant's spouse or dependent gaining or losing eligibility for <br />accident or health coverage provided or offered through this Plan or an <br />accident or health plan of the spouse's or dependent's employer; and (2) the <br />election change corresponds with that gain or loss of coverage. A change in <br />status shall result in gain or loss of coverage under the Plan only if the <br />individual becomes eligible or ineligible to participate in the Plan, including <br />any benefit package option available under the Plan. However, if an individual <br />gains eligibility for coverage under the Plan of the individual's spouse or <br />dependent, the consistency requirement is only satisfied if the individual <br />actually elects coverage under that plan. Regardless of the consistency <br />requirement, if the individual, the individual's spouse, or dependent becomes <br />eligible for continuation coverage under the Employer's group health plan as <br />provided in Code Section 4980B or any similar state law, the individual may <br />elect to increase payments under this Plan in order to pay for the continuation <br />coverage. Any new election shall be effective at such time as the <br />Administrator shall prescribe, but not earlier than the first pay period <br />beginning after the election form is completed and returned to the <br />Administrator. For the purposes of this subsection, a change in status shall <br />only include the following events or other events permitted by Treasury <br />regulations: <br /> <br />(1) Legal Marital Status: events that change a Participant's legal <br />marital status, including marriage, divorce, death of a spouse, legal <br />separation or annulment; <br /> <br />(2) Number of Dependents: Events that change a Participant's <br />number of dependents, including birth, adoption, placement for <br />adoption, or death of a dependent; <br /> <br />(3) Employment Status: termination or commencement of <br />employment by the Participant, spouse, or dependent; <br /> <br />(4) Work Schedule: A reduction or increase in hours of employment <br />by the Participant, spouse or dependent, including a switch between <br />part-time and full-time, a strike or lockout, or commencement or return <br />from an unpaid leave of absence; <br /> <br />(5) Dependent satisfies or ceases to satisfy the requirements for <br />unmarried dependents: An event that causes the Participant's <br />dependent to satisfy or cease to satisfy the requirements for coverage <br />due to attainment of age, student status, or any similar circumstance as <br />provided in the accident or health plan under which the employee <br />receives coverage; and <br /> <br />(6) Residency or Worksite: A change in the place of -residence or <br />work of the Participant, spouse or dependent <br /> <br />12 <br />
