CITY OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION NO. 13-092 <br />A RESOLUTION APPOINTING A HEARING OFFICER <br />AND CALLING FOR A HEARING TO CONSIDER THE SUSPENSION, <br />REVOCATION, IMPOSITION OF PENALTIES, OR NON - RENEWAL <br />OF AN ON -SALE INTOXICATING LIQUOR LICENSE FOR PARTNERS IN REAL <br />ESTATE, LLP, DOING BUSINESS AS MIRAGE BAR & GRILL <br />" I WHEREAS, on February 22, 2011, the City Council approved a liquor license and special <br />use permit for 400 Old Highway 8 NW and on September 27, 2012, the Council approved transfer <br />of the license to Partners in Real Estate, LLP, d/b /a Mirage Bar & Grill (the "Licensee "), which <br />lice0e was renewed on December 11, 2012; and <br />j WHEREAS, City staff has advised the City Council that the Licensee has not operated the <br />on -s�:le licensed premises in accordance with the requirements of law and that the continued <br />openation of the licensed premises by the Licensee may not be in the interest of the public; and <br />WHEREAS, violations by Licensee may include, but are not limited to: failure to operate <br />the emises as a restaurant as required by City Code Sections 4 -104, 4 -1(15) and 4 -131; failure to <br />maii ain good order and discipline as required by City Code Sections 4 -4 and 4 -11; sale to minors <br />in v lation of Minnesota Statutes, Section 340A.503; and conducting wrestling events on the <br />lice ed premises in violation of City Code Section 4 -127. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of New <br />Brigtitom Minnesota that: <br />1. The City Council hereby appoints Richard Rosow, attorney at law, to conduct a <br />hearing to consider the suspension, revocation, imposition of penalties and non- <br />renewal of the on -sale intoxicating liquor license of the Licensee, to prepare a <br />record, and to make findings of fact and recommendations to the City Council. <br />?. The City Manager is authorized and directed to retain Richard Rosow to conduct <br />such hearing and to take such further steps as may be necessary to effect the conduct <br />and completion of the hearing. <br />3. The City Manager is directed to provide notice of such hearing to the Licensee. <br />
