ECONOMIC DEVELOPMENT COMMISSION <br /> Supplemental notes to February 19,2014 EDC Meeting Agenda <br /> The following are supplemental notes for the regular meeting agenda. <br /> IV. New Brighton Exchange <br /> A. Discussion of offer to sell real property generally described as Outlots A and F, New Brighton <br /> Exchange 1st Addition * (Feedback Requested) <br /> The City, Ryan Co. and Colliers have been in discussions with a corporate user to acquire <br /> approximately 10 acres of land on the east side of Old Highway 8 in the area generally referred to as <br /> Outlots A and F, New Brighton Exchange, 1st Addition. The company is considering several sites and <br /> has requested that it not be identified at this point. This project is on a very fast track and as such the <br /> City Council has been involved in some of the negotiations in the last couple of weeks. In fact, the <br /> project was discussed in a closed work session on February 11th and a subsequent discussion is <br /> scheduled for next Tuesday (February 18th). The City Council cannot make decisions in a closed <br /> session, but it can discuss negotiations strategy. <br /> Staff believes it would be beneficial to provide the EDC with an update on the talks and solicit <br /> feedback (where appropriate) on the negotiations strategy. The most effective way of doing this is to <br /> close this portion of the EDC meeting to the public. If the EDC chooses to do so, the process would <br /> work as follows: <br /> 1. Chair identifies the topic to be discussed(description above would suffice) and solicits a <br /> motion to go into closed session to discuss pending offers on the sale of real property pursuant to <br /> Minnesota Statutes 13D.05. <br /> 2. If motion and second are made; EDC would then hold vote to close the meeting. If motion <br /> passes, chair would proceed to the next step. <br /> 3. All in attendance must be identified for the record, including commissioners and staff Any <br /> outside parties would be asked to step out during the course of the discussion. Chair should <br /> note the time when the discussion starts. <br /> 4. Closed discussion can occur. <br /> 5. Once closed discussion concludes, the Chair needs to entertain a motion to re-open the meeting. <br /> EDC would then vote on the motion and return to the regular agenda. Chair should note the <br /> time when the open meeting resumes. <br /> It is important to keep in mind that both minutes and audio will be kept and anything said in the closed <br /> session will be part of the record. The purpose of a closed discussion is to discuss strategy with respect <br /> to the offer and possible counter offers that would not otherwise compromise the City's position. If the <br /> City makes a deal in this case,the audio and minutes will become public. Virtually everything a public <br /> body does in a meeting must be public. This is one of a few exceptions under the open meeting law <br /> and is used rarely. <br />
