approved <br />Chair Howard asked about definable, quantifiable numbers. He stated to him this seemed to also be subjective. He asked <br />how would they have that discussion about what that represents to get to the prescriptive piece. Mr. LeFevere stated the <br />law did not allow a City to adopt arbitrary ordinances, but whatever regulation they had, including no regulations, was a <br />subjective judgment about what was right. He stated the City needed to write the best ordinances they could to achieve the <br />objectives. He stated the ordinances should be specific so it was understandable, not too broad. <br />Chair Howard stated as they have a discussion about the conclusions or recommendations, how much background would <br />they need to say as to why they did what they did. Mr. LeFevere stated all they might have is what they perceived the <br />community wanted. <br />Staff stated they could also use evidence base reasoning. Mr. LeFevere stated if they could find evidence, that would be <br />great and it should be used, but most of the time that won't occur. <br />A Member asked if he has ever seen a "tiered" situation with two different structural regulations based on numbers. Mr. <br />LeFevere stated he had not seen that. <br />Joe stated he has seen where there were regulations for a specific square footage per animal, heating/cooling regulations, <br />etc. <br />Mr. LeFevere stated on the animal welfare side, there was probably a lot of evidence based information, but as far as the <br />community was concerned, there might not be as much evidence. He indicated to come up with a perfect ordinance was <br />very difficult to do. <br />A Member asked if Mr. LeFevere had this kind of discussion with the Council. Mr. LeFevere stated he had not. <br />A Member asked if the next step was dividing up the various situations. Mr. LeFevere responded that would be a good <br />place to start. <br />Joe stated there was going to be a discussion coming up on the recommended next steps. <br />Staff member stated he believed they were on the right track and ultimately it came down to a task force advising the <br />Council what are the community values they believe are important and what as a group you can come to a consensus on. <br />He stated it would be much better to have a consensus than be divided on issues. He stated unanimous agreement would <br />bear a lot of weight on what the Council would or would not approve. He stated at the next meeting they could look at <br />what was and what was not important. <br />Mr. LeFevere stated the task force did not need to come up with an ordinance, but let staff write the ordinance, but rather <br />just give Council a recommendation. <br />A Member asked Mr. LeFevere if he thought the City had a problem with urban farming. Mr. LeFevere responded they <br />had controversy, but he did not get the sense that it was widespread. He stated a bigger problem he sees with Cities is an <br />adult bookstore goes into town and they don't have an ordinance. He stated they don't need to wait until there is a <br />problem. <br />A Member stated he was concerned that a bunch of ordinances would be created when there wasn't the need. He asked <br />what was the downside to waiting on this for a year to see if there were problems. Mr. LeFevere stated if the City knew <br />they didn't want certain animals in the City, then they should address that now and not wait until there was a problem. He <br />stated if there was no ordinance and a certain animal comes into the City that the City did not want such as a horse, cow, <br />etc., then there is no way to enforce not having that animal in the City. <br />4 <br />
