RESOLUTION NO. 14 -022 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION TO PURSUE METROPOLITAN COUNCIL ENVIRONMENTAL <br />SERVICES CLEAN WATER GRANT PROGRAM FUNDS FOR SANITARY <br />SEWER LINE REPAIRS <br />WHEREAS, The City of New Brighton has been advised by the Metropolitan <br />Council Environmental Services (MCES) that the City allows excessive Clear Water <br />inflow and infiltration (I &I) to be discharged to the Metropolitan Council's sanitary <br />collection and treatment facilities and that the City may be fined or required to pay <br />additional fees for such discharges; and <br />WHEREAS, The City of New Brighton has been designated by the MCES as a high <br />priority area and eligible to receive appropriations from the Clean Water Grant Program <br />for rehabilitation or service line replacement; and <br />WHEREAS, the Metropolitan Council has given notice that funding for this local <br />improvement project is available; and <br />WHEREAS, The City of New Brighton City Council adopted a water and sewer <br />service policy which states that "Private Sewer Services are all sewer lines from a private <br />structure or building to the public sewer in the street are private sewer services regardless <br />of size, and that the maintenance of any private sewer service shall be the property <br />owners responsibility "; and <br />WHEREAS, Elimination of I &I from the service line is considered by the City of <br />New Brighton to be maintenance of the service and that any costs associated with said <br />maintenance shall be the sole cost of the property owner; and <br />WHEREAS, Only sewer service laterals that are owned and maintained by the <br />property owner (private, governmental, institutional), between its connection to the <br />municipally owned trunk or lateral system and the first cleanout inside the building shall <br />be eligible for grant reimbursement; and <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF NEW <br />BRIGHTON MINNESOTA: <br />1. All sanitary sewer lateral repair work associated with Inflow and Infiltration <br />shall be submitted to MCES for eligibility approval for Clean Water Grant <br />Program appropriations. <br />2. Upon pre - approval, the City of New Brighton will enter into a standard MCES <br />agreement for fund reimbursement until funds are exhausted or the program is <br />terminated. <br />3. The City hereby designates the City Engineer, as the authorized City <br />representative for participation in the Grantee Program. <br />
