The FMLA leave and workers compensation leave run <br />concurrently. <br />16.15 Return to Work <br />An employee returning from leave should notify their supervisor as soon as possible of <br />there anticipated return to work date. The employee will be required to submit a fitness <br />for duty or return -to -work report, signed by the treating doctor, prior to returning to work <br />if FMLA leave was for the employee's own serious health condition. <br />The employee will be reinstated to the same or equivalent position with equivalent <br />benefits, pay and other terms and conditions of employment upon returning to work. <br />However, an employee has no guaranteed right to reinstatement or other benefits if the <br />employee would not have been continuously employed during the FMLA leave. For <br />example, the employee will not be reinstated: 1) if the employee is laid off during the <br />course of the FMLA leave, 2) if a shift is eliminated, or 3) if the employee was hired for <br />a specific term to work on a discrete project and the term or project is over. <br />16.16 Minnesota Parental Leave Act <br />As indentified in Minnesota Statutes sections 181.940 — 181.941, certain employees <br />are entitled up to six (6) weeks of unpaid parenting leave upon the birth or adoption of a <br />child. Eligible employees are those who have: <br />• Been employed by the City for at least 12 consecutive months preceding <br />the request for leave; and <br />• Worked an average of 20 hours or more per week. <br />The leave must begin within six weeks of the birth or adoption of a child. A request for <br />parental leave must be made ninety (90) days in advance of the first day of the parental <br />leave. The leave must begin not more than six weeks after the birth or adoption of the <br />child, unless the child remains in the hospital longer than the mother, then the leave <br />must not begin more than six weeks after the child leaves the hospital. No vacation or <br />sick leave, or other benefits shall accrue during a parental leave period. The employee <br />shall be eligible for group health insurance benefits during the parental leave, but will be <br />responsible for any costs of insurance premiums during the parental leave. <br />16.17 School Conference and Activities Leave <br />As noted in Minnesota Statutes section 181.9412, an employee will be granted up to a <br />total of 16 hours during any 12 -month period to attend school conferences or school - <br />related activities related to the employee's child, provided the conferences or activities <br />cannot be scheduled during non -work hours. An employee may substitute accrued <br />paid vacation leave or compensatory time for leave under this section. <br />16.18 Military Leave Request (March 12, 2013) <br />It is the City's intent and obligation to reinstate the rights of City of New Brighton <br />employees who are called into military service by law enacted by the Congress of the <br />United States or those who voluntarily enlisted during the effective period of such law <br />shall. Such rights shall be determined in accordance with the provisions of the <br />applicable law. <br />67 <br />
