RESOLUTION NO. <br />14 -031 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION AUTHORIZING THE CITY MANAGER AND THE COMMUNITY <br />DEVELOPMENT DIRECTOR TO NEGOTIATE WITH DEED TO DECREASE THE TWO <br />E} SEMENT AREAS AND REMOVE A SMALL PORTION OF THE PUBLIC IMPROVEMENTS <br />C6NSTRUCTED ON THE PROPERTY. <br />WHEREAS, the City of New Brighton (City) received various grants from the <br />partment of Employment and Economic Development (DEED) to make public <br />provements to property owned by the City and located in the right -of -way of <br />irthwest Parkway lying between Outlots A & F, NEW BRIGHTON EXCHANGE 1sT <br />)DITION (Property) and proposed for redevelopment, including a grant in the amount <br />$581,502.70 for sanitary sewer and storm water improvements for the Northwest <br />adrant III Project and a grant in the amount of $849,592.55 for sanitary sewer and <br />rm water improvements for the Northwest Quadrant Redevelopment II Project, and <br />WHEREAS, the proceeds of the grants were used to construct public improvements on <br />Property and specifically located within three easements held by the City on the <br />)erty, and <br />WHEREAS, pursuant to the Grant Agreement — Construction Grant for the Northwest <br />&ant Redevelopment II Project, SPAP -09- 0003- P -FY10 and the Grant Agreement — <br />istruction Grant for the Northwest Quadrant III Project, SPAP -10- 0023- P -FY11, the <br />agreed not to sell, convey or otherwise dispose the property improved with the <br />seeds of the grants, and <br />WHEREAS, the City is working with Ryan Companies, Inc. to redevelop the Property <br />in order for Cardiovascular Systems, Inc. (CSI) to locate on the Property and the City <br />plans to sell such Property to CSI, and <br />WHEREAS, during the finalization of plans for the redevelopment of the Property, it <br />s determined that the description of one of the easement areas was too large and <br />s uild be amended to decrease the easement area, and <br />WHEREAS, during the finalization of plans for the redevelopment of the Property, it <br />its further determined that a portion of the public improvements financed with proceeds <br />o 'the grants is located on a portion of the Property that is needed for the building project <br />an the public improvements be removed and the easement area amended to decrease the <br />ement area in order to proceed with the building project, and <br />WHEREAS, City staff would like to proceed with negotiations with DEED to decrease <br />thitwo easement areas and remove a small portion of the public improvements <br />strutted on the Property. <br />I <br />44�82v 1 JAE NEI36 -8 <br />
