<br />~ i <br /> <br />'I. <br /> <br />! <br /> <br />t <br /> <br />: 1 <br /> <br />RESOLUTION No. 99.080 <br /> <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF A MINOR SUBDIVISION OF CERTAIN <br />PROPERTY WITHIN THE CITY OF NEW BRIGHTON AT THE INTERSECTION OF COUNTY ROAD HAND <br />LONG LAKE ROAD. <br /> <br />WHEREAS, the City of New Brighton has been requested to subdivide certain property in the City <br />" of New Brighton described as follows: <br /> <br />See Attached Exhibit "A" <br /> <br />WHEREAS, State Statutes require that if such property is located in municipalities that have <br />adopted a platting ordinance, approval of the municipality must be obtained before such subdivisions <br />. j <br />can be filed; and <br /> <br />WHEREAS, Section 26-24 of the New Brighton City Code provides for subdivision of property <br />without platting if certain criteria can be met. <br /> <br />Now, THEREFORE BE IT RESOLVED, the City Council ofthe City of New Brighton approves the <br />i: subdivision of the above-described property into parcels described as follows: <br /> <br />See Attached Exhibit "B" <br /> <br />BE IT FURTHER RESOLVED, that the requested minor subdivision shall be subject to the following <br />conditions: <br /> <br />1. A grading and drainage plan must be submitted with a building permit application to ensure <br />that any grading associated with the construction of the two homes shall not have any negative <br />impacts on adjacent properties. <br />2. There shall be no building encroachment into the utility easement to be established along the <br />Western property line. <br />3. The applicant shall work with the City's Engineering Department in regard to utiIiy hook ups. <br />4. Driveway access off of County Road H shall be subject to review and approval of Ramsey <br />County. <br />5. Approval shall be contingent on the applicant(s) providing title opinion or proof of title <br />acceptable to the City Attorney. <br />
