j NMI Report Number 14 -120 <br />Agenda Section VI -3 <br />the city that works for y Council Meeting Date May 27, 2014 <br />REQUEST FOR COUNCIL CONSIDERATION <br />ITEM DESCRIPTION: CONSIDERATION OF STORMWATER MANAGEMENT <br />FACILITIES MAINTENANCE AGREEMENT FOR PROJECTS LOCATED WITHIN THE <br />NEW BRIGHTON EXCHANGE <br />DEPARTMENT HEAD'S APPROVAL: i <br />CITY MANAGER'S APPROVAL: <br />No comments to supplement this reps <br />Comments attached <br />Recommendation: Subject to the aploval of the City Attorney, enter into a Maintenance Agreement <br />with Rice Creek Watershed District (RCWD) for inspecting and maintaining stormwater management <br />facilities delineated and labeled on Exhibit A. <br />Legislative History: None <br />Financial Impact: The City is responsible for the maintenance and inspection of all drainage facilities <br />receiving public stormwater. <br />Explanation: When the New Brighton Exchange was original redeveloped, ponding and filtration <br />facilities were built to regionally treat future development areas. The City is working with Pulte, CSI, <br />and API to utilize these previously created features as part of their individual developments. With the <br />proposed improvements, RCWD Rules require the developers to provide Best Management Practices <br />(BMPs) that minimize pollutants discharged to downstream surface waters. RCWD Rules also require <br />the City to demonstrate that we approve of private party use of our regional facilities and that the <br />facilities can accommodate additional drainage. The maintenance agreement includes the City providing <br />as -built surveys demonstrating that the stormwater features were built according to plan and routine <br />"yffels, the City of New Brighton. <br />Director of Public Works <br />Attachment: Mainte nance Agreement <br />Exhibit A <br />
