RESOLUTION NO. 040 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />ON MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN AND NONCONFORMING USE <br />WHER ', an application has been made by Caleb Wilkins on behalf of Eurotech Auto to consider <br />a Sit Plan and Nonconforming Use Permit to allow construction of a 26' x 32' open air canopy <br />to the northeast corner of the existing building at 480 5th AVE NW /Old Highway 8 NW (also <br />knov Ii at 408 5' ST NW). <br />WIiEREAs, the procedural history of the application is as follows: <br />1 Application for a Site Plan was received on May 2, 2014. <br />2 A public hearing notice was published the New Brighton area Sun Focus on May 9, 2014. <br />3 Public hearing notices were mailed to property owners within 350' of the applicant's <br />property on May 7, 2014. <br />4: The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on May 20, 2014 and all present were given a chance to freely speak at the <br />hearing. <br />5, The Planning Commission recommended approval to the City Council on May 20, 2014, <br />subject to conditions. <br />WHE S, the Planning Commission and City Council make the following Findings of Fact with <br />respect to the proposed Site Plan (LP2014 -003) and Nonconforming Use Permit (NC2014 -002): <br />1 The property is located at 480 5" AVE NW /Old Highway 8 NW with 408 5th ST NW <br />also being a valid address. <br />7 The property is zoned B — 3, General Business. <br />3 The property is guided in the New Brighton Comprehensive Plan for CB, Community <br />Business. <br />4 The total property area is approximately 40,929 SF or 0.94 acres. <br />5 The applicant proposes to construct a 26' x 32' open air canopy addition at the northeast <br />corner of the existing building. <br />6 Additionally, the applicant proposes to install 3' of dry stack stone and stucco exteriors <br />on the north and eastern facades and paint the entire building a natural beige color. <br />7 No parking lot improvements are proposed. <br />8 The Planning Commission reviewed Site Plan in accordance with Zoning Code Section <br />8 -010, and found all applicable criteria to be met with regard to building setbacks, <br />building height, floor are ratio, parking setbacks, required number of parking stalls, <br />landscaping, exterior building materials, and signage. <br />9 The Planning Commission examined the following nonconformities on the property: <br />a. Front and side street yard parking setbacks less than 30' <br />b. More than the allowed number of driveway entrances (2 is allowed, 4 exists) <br />c.
