Sec. 15-60. Restrictions. <br />The conditions of this Section shall apply to the issuance of a license. <br />(1) No license shall be issued except to a person of good moral character. <br />(2) No license shall be issued for the sale of tobacco at any place other than the applicant's established <br />place of business. <br />(3) No license shall be issued for the sale of tobacco at more than one place of business. <br />(4) No person shall sell or give away tobacco to any person under eighteen years of age. <br />(5) No person shall keep for sale, sell, or dispose of any tobacco containing opium, morphine, jimson <br />weed, bella donna, strychnia, cocaine, marijuana, or any other deleterious or poisonous drug except <br />nicotine and other substances found naturally in tobacco or lawfully added as part of the manufacturing <br />process. Age Restrictions. <br />No person under eighteen years of age shall purchase, possess, or consume tobacco. (Ord. No. 78, 6 -17- <br />58; Code 1966; Code of 1988; Ord. No. 642, 6 -9 -98; Code of 2001) <br />Sec. 15-64 License Displayed. <br />The license shall be conspicuously displayed at the licensed business location and shall be exhibited to any <br />authorized person upon request. Penalties. <br />This Section prescribes administrative penalties for violation of this Article. The penalty amounts shall be <br />as specified in Minnesota Statutes, Section 461.12. No penalty under this Section shall take effect until the <br />licensee has received written notice of the alleged violation and has had an opportunity for a hearing <br />before the City Council. The notice may be served personally or by mail. The decision of the City <br />Council shall be provided in writing if a violation is determined to have occurred. Judicial appeal shall be <br />as provided for by State law. <br />15 -7 <br />
