a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />b. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />d. That adequate utilities, access roads, drainage and /or necessary facilities have been or are <br />being provided. <br />e. That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />9. The Planning Commission and City Council determined that all special use conditions of <br />Section 9 -041 and Section 8 -130 have been met, based on the following points: <br />a. The proposed monument sign is no larger than the existing monument sign. <br />b. The proposed monument sign, and the justification for two monument signs, is that they <br />provide identification for tenants of two buildings that reside on a corner lot. <br />c. The proposed monument sign setback is consistent with the existing monument sign <br />setback. <br />d. The larger logo signs are insignificant when viewed from two stories up. <br />e. The wall sign graphics are consistent with the originally approved Comprehensive Sign <br />Plan for Main Street Village. <br />Now THEREFORE BE IT RESOLVED that based upon the above findings of fact the application <br />for a Special Use Permit (SP2014 -004) is hereby approved consistent with the plans attached <br />as Exhibit A to this Resolution. <br />Adopted this 22nd day of July, 2014. <br />ATTEST: <br />Karen Halley, Deputy City Clerk <br />Dave Jacobsen, Mayor <br />Dean R.
