Approved <br />Approved 6 -0. <br />(D) Evan Staples on behalf of Honest -1 Auto Care requests a Special Use Permit to allow an automotive <br />repair use to be operated out of the existing building located at 2166/2176 Silver Lake Road (known as <br />the former Lowell Auto Parts store). <br />Planner Janice Gundlach reported the applicant is requesting a Special Use Permit to allow operation of an automotive <br />repair business out of the existing building/storefront at the north end of Rice Creek Shopping Center, specifically <br />2166/2176 Silver Lake Road, known as the former Lowell's Auto Parts store. The property is zoned B -3, General <br />Business whereby Zoning Code Section 5- 240(7) states that "automotive services, service stations, service garages..." are <br />a specially permitted use. The applicant intends to occupy storefront facing Silver Lake Road, as well as renovate the <br />eastern and northern facades of the building. The improvements to the eastern facade include minor changes to the <br />mansard roof line and the addition of two pillars. The improvements to the northern facade consist of removal of the main <br />windows, door, and mansard roof and installation of five new overhead service doors. The proposed build out of the <br />space would include seven service bays facing Mississippi Street and a storefront/lobby /waiting area along Silver lake <br />Road. Other than the northern and eastern facade renovations, no other exterior improvements are proposed to the site, <br />including to the existing surface parking lot, which is adequate to serve the business's needs. <br />This portion of Rice Creek Shopping Center has been vacant for at least the last 8 years. The proposed business will have <br />to co -exist with the existing China Tiger restaurant, which would remain. None of the parking or traffic flow patterns will <br />be altered and existing shared parking and access easements will be unaffected. Staff recommends approval of the Special <br />Use Permit as requested and subject to the following conditions: <br />• A grading plan shall be submitted for Engineering/Public Works Department review and approval at the time of <br />building permit. The plan shall depict existing contours, proposed removals of bituminous, concrete, etc. and <br />proposed contours and spot elevations illustrating how the new driveway aprons for the new overhead doors will <br />be installed. <br />• Existing graffiti on the parking lot signage, trash enclosure, and west wall of the building shall be <br />removed /painted over prior to issuance of a building permit. <br />• Exterior storage or display is prohibited. <br />• Occasional overnight parking of vehicles shall not exceed 5 cars, all of which shall be fully operable with current <br />license tabs. Any other vehicles shall be stored indoors overnight. <br />• Vehicle sales are prohibited. <br />• Installation of wall or ground mounted signs requires a separate Sign Permit. <br />Commissioner Deick asked if the parking lot would need to be striped. Planner Gundlach reported the parking stalls were <br />currently clearly delineated. <br />Commissioner Danger questioned if a separate HVAC unit was required for the automotive repair space. Planner <br />Gundlach noted this was discussed with the building inspector and a separate unit was required, along with a fire rated <br />wall between the auto repair area and the adjacent restaurant. <br />Evan Staples, Honest -1 Auto Care, discussed his plans for the Rice Creek Shopping Center. <br />Commissioner Danger inquired how often hazardous materials would be removed from the site. Mr. Staples explained <br />this would be based on use, but noted the Blaine site was cleared of hazardous materials every three weeks. He noted the <br />storage tanks would be stored indoors. <br />Motion by Commissioner Danger, seconded by Commissioner Deick to close the Public Hearing. <br />Approved 6 -0. <br />5 <br />
