CITY OF NEW BRIGHTON <br /> ORDINANCE NO. <br /> 820 <br /> AN ORDINANCE FOR PROTECTING THE PLANNING <br /> PROCESS AND THE HEALTH, SAFETY AND WELFARE OF <br /> THE RESIDENTS OF THE CITY, PLACING A MORATORIUM <br /> ON NEW DEVELOPMENT ON CERTAIN PROPERTY OF THE <br /> CITY OF NEW BRIGHTON FORMERLY USED AS RAILROAD <br /> RIGHT-OF-WAY <br /> THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS AS FOLLOWS: <br /> Section 1. Background. <br /> 1.01. Certain property in the City that was previously owned by the United States <br /> Government and used as railroad right-of-way has been sold and is now in private ownership. <br /> 1.02. Because of the ownership and use of said property said property has not been <br /> addr sed in the City comprehensive land use plan and does not have a zoning designation on the <br /> City 8 zoning map. <br /> 1.03. Accordingly, there is no guidance in the City's comprehensive land use plan and no <br /> official controls, or inadequate official controls, for the zoning, use and development of said <br /> props ty. <br /> 1.04. Therefore the council has determined that there is a need for further studies to be <br /> con Ucted so that the city may adopt appropriate amendments to its comprehensive plan and zoning <br /> cod o as to ensure protection of the public, health, safety and welfare. The council has directed 1 <br /> that s ch studies be undertaken. <br /> 1.05. Due to the potential for use or development of said property that may not be <br /> cons' tent with future amendments to the comprehensive plan and official controls, the council has <br /> det• fined that there is a need for an interim ordinance to be adopted pursuant to Minnesota <br /> Sta tis, Section 462.355, Subd. 4, for the purpose of protecting the planning process and the health, <br /> safet, and welfare of the citizens of the city, and ensuring that the city and its citizens retain the <br /> bens is of, and the protection sought to be afforded by, the city's comprehensive plan and zoning <br /> or.' ! ces until the study process is complete and any modifications to the city's comprehensive <br /> plan ; d zoning ordinance become effective. <br /> Seetic 2.
